CCA Request Query - Another one!

Capital One have instructed Fredrickson International to obtain the full amount I owe Capital One.

I haven't recieved notification of assignment from Capital One, nor any post from FI despite assurances that 2 letters have been sent.

I have sent a CCA letter to FI, should one to C1 too?

    Who says that Cap 1 have demanded the full amount?

    That sounds like a standard FI tactic.

    If a debt has been sent to debt collection, it is against OFT Guidelines for a DCA to demand more than the debtor can afford, so if you have this demand in writing, I would send a copy to the OFT and the local trading standards, or advise FI that is what you intend to do next time they contact you.

    PS, it is also against the rules to pursue a debt whilst it is in dispute, which this debt is since you have requested the CCA.

  • hi ras wonder if you can put my mind at rest sent cca last week to dca for debt that was never mine.got another letter yest demanding I pay by 18th Feb,should I ring them or just sit and wait

    The common DCA responses to a CCA seem to be some sort of threat to take action that is more serious than that they suggested in the first letter. "referring your account to our legal department which may lead to CCJ, charging order or bankruptcy" is an old favourite. of course they can refer it, but without the CCA they would be stupid to take it to court. The relevent word is "may".

    Why do you think they want you to pay up by Feb 18? That would allow them to avoid defaulting.

    Sit tight, keep calm, expect at least one more attempt to panic you into paying before the 20th and come back here if they get to you.

    I have another credit company for which i have requested the DCA letter. The 12 + 2 expired on 24th Jan, and I still haven't heard anything. I'm ready to send a final letter after 30 days, on 21st Feb.

    What does the 12 + 2 + 30 mean?
