help money gone missing

I need help my partner is in the army he is usually based in germany but was sent to afghan while he was there he got a 'friend' to pay money to a car loan he had. He felt they were trust worthy and left his bank card and asked them to withdraw the amount each month and pay it through their german account to the loan company. nearly 2 years on he has just found out that the loan company is saying they never recieved any of the money and have past the debt to a collection agency in germany. he as not recieved any letters until dec07 when one was sent recorded to the army not him getting them involved. the person who said the money was paid is not beng helpful she did forward some receipts saying money was paid but it appears it was into the wrong account number for finance company. the person is saying that the money has not been credit back into her bank account wich is what the bank advised would happen in these circumstances. however the bank could not talk about the specific account because the person needed to authorise for them to do so which they will not. My partner is now having to repay the loan for a second time with the addition of more interest and added costs that have incurred We dont know what to do has anyone any ideas or knowledge of rules in germany.

    u need to get back to the person regarding the refund of the money put into the wrong account...
  • the person who paid the money into the bank is refusing to help they are saying its not their problem. the bank will not talk about specific accounts as they not in my parters name. the friend paid money through their account. we have found out even the slightest error on the payment details would have ment the money would have come back into the payee acount they said it didnt!!! We are now about to take police action against the so called friend. and we are having to pay the loan again for a second time

    Any other suggestions would be appreciated
  • If the police are involved you can't do much more until after the investigation. Someone is obviously lying.

    If the loan has not been paid then for now he will have to make the payments.

    Don't forget that if you give someone your bank card it will invalidate any fraud claim. my cousin works in a bank and she told me this as i send hubby down to cashpoint to get money out for me. Even that is not on apparently.
    I would put this one down to experiance, hard as it is.
