Liability For Commerical Rent

Be very grateful if anyone can help me with his question. Is somebody occupying the business premises liable for rent if they have never signed a lease? My husband and his brothers took over a business from their father after he died occupying council premises, they never signed a lease and got into arrears with the rent to the tune of £18,000 they are numerous other business debts which we are tyring to deal with and someone suggested that they may not be liable for the rent as they never signed a lease. thanks for any help.

Contracts don't have to be written, if the rent has been paid in the past and the business is occupying the premises then a contract has been created.
Distinguish between a debt of the business and an indivdual's debt. If the business is a separate legal entity then the debts don't come home to roost (at least not on individuals).I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
