How to remove a CCJ

Can anyone advise how to remove a CCJ?

It has been paid within the month that it was issued - however, there was no date on the form from the court that advised the dead line. It is dated 11th January and has now been paid in full. I understand that you have to provide proof of payment to the court but is that it with a covering a letter? The leaflet provided doesn;t really advise much.

    Send a copy of the letter confirming that the judgment has been paid and the date it was paid along with a covering letter stating that you would like the judgment to be cancelled (if it was paid in the 28 days). Make sure you put the claim number on your letters. If you want a copy of the certificate for your records then include a court fee of £15.00. If you dont want a certificate sending to you then there is no court fee payable. x x

    That's handy to know.

    I thought that the fee was always payable if the Registry Trust were to be updated (and hence the Credit Reference Agencies) that the judgement was satisfied.

    But I suppose it makes sense that it's not.

    The court fee used to be payable until about 2 years ago when they changed the rules (Registry Trust get our updates electronically now whereas we used to post certificates to them for them to update themselves so I suppose there is less work involved.

    You may still have to argue the toss with some courts though - Im off to see if I can find some info on it! x x

    Ah. I've read that before but I obviously didn't at the time recognise the distinction between the first bit regarding getting the judgement removed from the register, and the separate second bit which refers to obtaining the certificate requiring the fee.

    It's obvious now, but isn't that clear if you don't read it as carefully as you should.:o

    thanks for the info.

    However, the claimant has now requested an attachment of earnings. The form to be filled in requires that i fill in my employers details and returned within 8 days.

    I contacted the local court and informed them that the debt has already been paid. They have advised that they need confirmation from the claimant, of payment and notification to cancel the attachment of earnings. I've tried contacting the claimant and it's just an answer phone all the time - i have left messages advising them that payment has been made - i had even over paid them by £60 quid!!

    My concern is the attachment of earnings. Have the courts requested this already or will they do so if i don't pay within 8 days (even though it's paid). I don't want my employer to find out.

    The N56 (the form that you received) does need to be completed within the 8 days or it will go to the next stage which is the N61 to be issued (where bailiffs will personally serve you with the forms) at the same time the court will also issue an N338 (which goes direct to your employer for them to inform the court of your earnings). It may be worth contacting the court to see if they have any alternative contact numbers for the claimant or their solicitors. Failing that, you may have to make an application to stay the enforcement action whilst you apply for the confirmation that the debt has been paid. x x

  • Im sorry to re-open this subject but I was curious if there was any way to have a CCJ set aside after repayment in full has been made as a result of an attachment of earnings? I am desperate to improve my credit score but this appears to be the main contributing factor to my measly 593!! (An improvement over the original 483 but still poor!)

    Any advice would be gratefully received
