That really really isn't evidence that it was them. It's not evidence of any sort - it's a deduction of yours using false logic from a doubtful premise.

I know its not proof, hence my post for advice on how I can prove it!?!
Trust me there is alot more that has gone on and been said over the months that has lead me to the person who did it.

Just as likely: someone in the company who doesn't like you tipped them off privately. Against the DP Act, sure - but totally unprovable - there will be no documentation within the company that it has happened.
That's why I'm not looking within the company for documentation (although they are completely thick and it is not out of the realms of reality that they may have filed a copy on my personnel file!) But I do know them and know they will have done it by letter so documented proof exists... with DVLA.

Stick to what you can prove - or it will cast doubt on the truth
The lesser charges of breach of confidentiality have been admitted, I haven't mentioned anything about this yet and won't unless I can get proof.

Sorry but why weren't Occupational Health informed of your disability when you informed your company surely the would have had to make some assessment of your work space etc.
Hence a claim of Disability Discrimination and failure to make reasonable adjustments!! The company do not have a clue and believe they are above the law! They knew about my disability for 4 years & in the end I had to raise a grievance and appeal and write several more letters before being allowed to see Occupational Health!
I suppose the other question is, since you have stated it was the Personnel Department tat contacted them and this consists of only one person, did this person do it on behalf of the company or as an 'individual'.
Knowing the company and the person involved I would lay money on it being a letter on headed paper.

Can you be absolutely certain that it was not the GP? If the employer specifically asked about your fitness to drive, could this have prompted the GP to realise that DVLA should of been notified?

Definetly wasn't my GP, I never allowed my company to ask my GP about fitness to drive to & from work as it is none of their business.
Plus GP's have a duty to inform their patients if they have or are going to breach confidentiality and he wouldn't be supporting my fitness to drive if it had been him.
