Long story, but my husband left his old job at RBS on a pending disciplinary for absence. He now has a new job at Barclays, but RBS are not giving Barclays the details of the disciplinary, so they have had to suspend him for 2 weeks, as for all they know... the disciplinary could be about anything, like fraud etc, and they cant just take my husbands work for it.
We have requested details of the disciplinary from RBS under tha data protection act, but are strugggling, so CAB recommended we send a grievance letter.... Is this okay? have we missed anything. Thanks.
Also, what department should we be sending this to... HR????
Dear XXXXXX
RE: XXXXXXX, Employee Reference Number: XXXXXXX
I am writing to tell you that I wish to raise a grievance.
This action is being considered with regard to the following circumstances:
A breach in trust on confidence that continues to exist between an ex-employee and the employer.
By not disclosing the reason for my disciplinary, I feel that you are being disingenuine and jeopardising my career.
I want you to divulge this information under the Data Protection Act 1998, or I will be seeking legal advice and reporting you to the Information Commissioner’s Office.
Please reply urgently to the above address.
Yours sincerely,
Mr. XXXXXXXX

TBH I would go back to the drawing board with the above letter, as you are confusing informal language with formal, and your paragraphs do not flow.
You have not stated the reason for your grievance. All you have done is quoted a legal phrase.
Do you wish to raise a grievance, or do you wish to make a Subject Access Request?
If I received this letter, my reply would be:
* Do you want us to consider this as a grievance letter, or are you just wanting to tell us that you wish to raise a grievance?
* What is your grievance?
* What does disingenuine mean?
* What is a breach in trust on confidence?
* On what grounds do you intend to report me to the ICO?
Sorry to be harsh, but your letter really won't get you far.
If you are not legally trained, then I would move away from using legal terminology. It is an area that many lay people trip up on.
Rewrite the letter using language that you are comfortable with. Then repost and I'm sure the feedback will be a lot more positive! xGone ... or have I?0 -
Dear Sirs,
As i am sure you are aware you provided my prospective employer with a written reference recently. It was noted that you did not include the reason for my disciplinary.
As i am entitled under the Data Protection Act of 1998, please accept this as a formal request to disclose the reason for my disciplinary in the form of a letter addressed to myself.
I would be grateful if you could deal with this as a matter of urgency.
Many Thanks.
Yours faithfully
Feel free to use that letter if you would like. Send it to HR.
You will probably find that Barclays have just send a standard dates/reason for leaving reference, as most large companies do nowdays. I really don't think you have grounds for a greivance."On behalf of teachers, I'd like to dedicate this award to Michael Gove and I mean dedicate in the Anglo Saxon sense which means insert roughly into the anus of." My hero, Mr Steer.0
