Ooops!

Buchanan Clarke and wells just called asking for me to pay a talktalk bill I supposedly owe...like always I told them I wont be paying a penny until carphone warehouse supply me with a breakdown of these costs (I dont believe I owe it) which, after about a month of promises to send one out and failing to do so, I suspect carphone are having a bit of trouble proving I owe this!

Anyway, the debt collector called asking for payment - told her still waiting and no payment will be made UNLESS talktalk can prove I owe it. Think I may have made a rod for my own back!

Convo went like this:

BC&W: You made a promise to pay half of the balance...
Me: No I didn't I said I would pay it IF talktalk could prove I owed them
bc&w: Well, Mrs P******, it was me you spoke to last time and you did promise to pay 50% of the balance so dont say you didn't!
Me: What? Dont F*cking lie!

I then put the phone down on her.

I just got so angry! I have had enough of DC's using bullying tactics and the way they try and twist things. I shouldn't have lost my temper as I know they are going to be complete a*seholes now (well, more so than before!). What have I done?!!!! Arghhh!

    Should I request a cca? I dont think I owe this anyway, but bc&w are just getting on my nerves. What do you think? Any advice?

    you know i had a friend who got a phone call from a dca who said "i spoke to your mum on friday she said you would pay today" my friend said "are you sure it was my mum" the dca said yeah "your mum said i'm ****** mum you can be sure i will make her pay it" ...to which my friend replied "well can you tell me how you did that my mum has been dead for over 12 years and i would love to have a chat with her" so i wouldnt worry too much about the dca

    They are unreal aren't they? I'd love to know what their gaffers tell them to do in training - do they have to go on a course on how to lie through their teeth I wonder. I'd love to be a fly on the wall at their training days! :mad:

    Should I request a CCA? Is that the right way to go about this?

    When I spoke to BC&W a while ago they told me to pay it, even if I didn't owe it, then I could ask talktalk for a refund when I provided evidence that I didn't owe it. I dont want to do this though - why should I pay for something when I'm sure I dont owe it? I doubt I'd get it back anyway.

    Just need to know if the cca route is the best one to take at this moment in time, as bc&w are, as they say, taking this further regardless of me telling them I'm waiting on a breakdown of costs I apparently owe from talktalk.

  • Yes but don't sign anything you send to them as they have been known to copy the details onto CCAs.

    All you need to tell BCW that you are in indispute with Talk Talk about the outstanding amount and as such they should cease trying to collect the debt as per the Debt Collection Guidelines as set down by the Office of Fair Trading.

    To be a debt colection agency they have to have a licence to trade, which is issued by the OFT and as such debt collectors have to follow these guidelines.

    The relevent sections you can quote are below
    Physical/psychological harassment
    2.5 Putting pressure on debtors or third parties is considered to be oppressive.
    2.6 Examples of unfair practices are as follows:
    h. ignoring and/or disregarding claims that debts have been settled or are
    disputed and continuing to make unjustified demands for payment

    Deceptive and/or unfair methods
    2.7 Dealings with debtors are not to be deceitful and/or unfair.
    2.8 Examples of unfair practices are as follows:
    k. not ceasing collection activity whilst investigating a reasonably queried or
    disputed debt.


    I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!
