Annual Increase?

Hi all,

My ex will have had an annual pay increase starting with effect from 1st Jan 2008, and also this month will receive his annual bonus in his salary.

Last year I got the CSA involved for the first time because I knew he wasn't paying what he should have been - so now 12 months on I would like to approach them again to try for an increase in the maintenance he pays (his bonus is usually very large).

Is this right way to go about things? (Talking to him is like :wall: )

Meant to add that CSA do not collect the payments it is all still done between ex and I.

    Ask for a variation of income. While you are at it, you could also ask for the money to come off his wages right away, through a Deduction of Earnings.

    The CSA will fob you off, saying that they can't instigate a DEO, unless he defaults, but that is rubbish, just insist on it, and explain to them that he isn't being upfront about his income/bonuses.

    Thanks for that enemes - as he gets his bonus annually would they divide it by 12 and make monthly payments?

    I don't know how the CSA deal with bonuses, I'm afraid ... someone with a bit more knowledge will hopefully come along with more on that issue.

    BTW ... love the "hitting head against the wall" smilie ... where did you get that?

  • yes the bonus is divided by 12, also (i may be wrong) but the csa will only change an assessment if the nrp wage has increased by 5% or more. i do not think they can impose a deo as it is up to the nrp how they pay (although the pwc decides if its direct to them or paid via csa) as long as they do pay. has your ex been paying the amount csa have told him to over the last 12months if so (and i don't know all your circumstances) but you are not doing pwcs any favours you are coming out as a greedy pwc, you dont say what/if your ex was buying for your child, how often they saw him/her etc. he may have had his bonus included in the last assessment for all you know as it just shows as a lump gross income, if he's receiced less this year your assessment may go down!!
  • Hiya At the min the agency dont revisit cases unless asked to do so by either client. so give them a call and ask for a supersession to be completed. With regards to asking for a variation to be completed the onus is would be on yourself to provide proof that he hasnt declared income etc. It is illegal to impose a DEO for a compliant NRP so again that is only something that could be done if payments have been missed or if the non resident parent wishes to pay by deduction from earnings.

    sorry meant to add the way his bonus will be calculated is :-
    Total amount of gross bonus is taken from the 52 weeks prior to the effective dae of the case or change

    This is then worked into a weekly figure

    The tax and National insurance is then worked out on this and the weekly net amount of bonus is added to the net income.

  • The time to call them is the month after he receives his bonus as they will then ask for his wages including the bonus, so he can't hide it. (beginning of March)
    The CSA look at the 52 weeks prior so if you call now they will still look at last years bonus.

    Also a variation is a different thing and I doubt it would apply in your case unless he is a company director.

    If you have direct pay between yourselves then you can simply ask for the CSA to collect payments, but frankly if it works between you I would advise to keep it between yourselves

    This is untrue the csa cannot impose a deo without giving the non resident parent an opportunity to comply with the agency and pay, as it would be illegal.

    Hi Cozworth,

    He is a Company Director! And I will give CSA a call at the end of February to see what can be advised - thank you.

    Stressed Eric I understand exactly what you are saying by not wanting to appear a greedy pwc - but there are circumstances in which I find myself where I need to make sure that my ex is paying exactly what he should be - its a difficult one isn't it?
