They ignored letter...what now please??

Hi All

I posted back in January that i was being chased by two debt collection services for debts i do not owe, i was advised to write and send recored with a £1 postal order a letter stating "I do not acknowledge any debt to your company" etc etc which i did on the 28th Jan and retained copies.

I have today received from one of the companies namely Fredrickson International Ltd a letter yet again demanding payment for said debt saying i have failed to make a acceptable repayment proposal and in big huge capital letters stating "THIS DEBT WILL NOT GO AWAY" and issuing me with a payment card!!!!!

Theres no reply or mention of my "I do not acknowledge any debt" just another demand for payment.

Please help they seem to have totally ignored my request for a true copy of the original debt agreement, what do i do now please???

    Write and refer to your first letter , tell them as they did not respone you will be reporting them to the OFT .

    Is there an offical letter to do next or do i have to wing it.??

    It is not at all uncommon for DCas to respond to a CCA request by upping the anti. It is in complete breach of OFT Guidelines etc, but that does not stop them.

    You should assume that the next letter will advise you that they are referring the account to their legal department which could lead to a CCJ, charging order or bankruptcy. Note "COULD", but not whilst they have failed to provide the CCA. More likely the legal department will tell them that without a CAA they are going nowhere.

    When did you send the CCA letter? On what date did they sign for it?

    It was sent on the 23rd of Jan and signed for as received by them on the 25th Jan, there latest letter to me is dated 1st Feb.

    Your 12 working days is up on Feb 12. At this point they are in default.

    You could send them a letter reminding them, but it may be as well to ignore them unless they write another stinker that actually has legal implications.

    One month after February 12, you need to send the bog off letter.

    In the meantime keep copies of everything and be ready to send a packet of stuff to the TS etc when their time runs out. If they do not send back a letter confirmaing that they have removd you from their records, or they transfer your records to another DCA after the deadline, then it is a matter for the Information Commissioner.

    what does the bog off letter say??Is it a standard letter?
    what does TS stand for??
    And finally who is the information commisioner and where do you get hold off them??

    Sorry but im not the brightess spark in the pack when it comes to debt problems im sorry to say.

    Tell them to send you proof and a breakdown on what they are chasing you for.if they dont contact the ombudsman and report them.you never know it could be itentity theft .

    Del67...I have already done so, just waiting for the time to run out for there reply, in the meantime they still hound me for payment refusing to send the info i have asked for.
