Moved out of house. Few questions please

Right so i've taken the next step and i moved out of my house completely at the weekend and have moved into my parents house.

I phoned the mortgage company today to say that i wanted to do a voluntary repossession. They said they would send the form out to me for me to sign and send back with the keys. Obviously from being a heavy reader on this site i know that i am not meant to sign this form or at least amend it and send it back.I asked the mortgage people what would happen if i did not sign it and they said they would not be able to do a voluntary repossession and they would take me to court and start eviction process - i told her that i had already moved out hee hee but she said i still wouldn't be able to do a voluntary repossesion.

So i was wondering what would be the best option from people with experience - should i just cross out the relevant bits the sign it or should i write a completey different letter in my own words?

Has anyone had any problems from their mortgage company when changing the form?



Another quick question. My BT phone line and my tiscali internet provider have a contract with me that runs for 18 months and i have only paid for 12 months. Both of them are saying that because i have cancelled before 18month contract is up that i have to pay cancelleation charges. Should i pay these or will this be classed as preferantial payment to creditors? If i don't pay them do they fall into bankruptcy? what should i do :confused:

    We had the form from our mortgage company last week. We're not signing it and have done a letter to them instead. I did post it on here last week for opinions, the title of the thread was "Voluntary Surrender" if you're interested :) I don't know what they'll say or do about the fact that we're refusing to sign the form, I'll let you know when I hear from them ;)

    When they say that you can't do the "Voluntary Surrender" without signing their forms, as far as I can see that would be giving back the house on their terms.

    Well, 'stuff' their terms (to put it bluntly), you want to do it on yours.

    You could write a letter similar to the one by Scarlett.1974 here:

    with your tiscali and BT just ignore them and add them as a creditor. The debt can be written off in your BR. I assume you haven't already done the deed?

    No NekoZombie i haven't gone bankrupt yet - i'm planning on doing that in the next few weeks.

    Scarlett i've been following threads more than anyone elses because you seem to be doing what i want to do and it has been very helpful thanks x
    I saw your letter and i was thinking of maybe doing the same thing so yeh let me know if the mortgage company gets back in touch with you.

    ooo i've just remembered something else. The mortgage company asked if i was bankrupt and i said no however if i go bankrupt in the next few weeks and they don't manage to sell my house for a few months will this cause some problems?

    Not for you, as far as I know.

    Despite the property being sold after the BR, your liability for any mortgage shortfall and secured loans were made/incurred before the bankruptcy. So they are included in the bankruptcy.

    Hee hee - wine glasses are not yet unpacked - need to have a straight head for all the dreaded forms i've yet to fill in but believe me - the wine glass that can fill a whole bottle of wine in it will be the first wine glass to be unpacked once forms have been done ;o)
