HFC taking me to court
ANGSTDATA

Hi everyone
We are on a CCCS debt plan and are paying our 11 creditors on the plan at the moment , some are playing ball ,but some are still charging interest and one HFC is taking us to court and added a further £1500 to the debt for collection charges etc ( great that really helps ! )
To make things even more wonderfull my contract work has dryed up and CCCS have told us our plan is now unworkable ,so will have to contact the creditors again and offer them all a pound a month token payment ( including the HFC )
My question is does anyone have any similar experience and if so what happened , what could happen etc
As i said, some of the creditors have accepted payment of £30 - 40 a month and some havnt, now Ive got to tell them all about not having any work and wanting them to accept £1 a month !
We have a house with mortgage and some equity in it
which we are selling to downsize hopefully to get some cash to pay them off
Northern Rock who our mortgage is with isnt helping either as they wont give us another mortgage on a smaller house as we are on a DMP so will want £4000 exit fee because we have to get it elsewhere at a higher rate ,so we can sell the house , make some profit and hopefully pay of creditors ,then our credit would be good again and then Northern Rock would want to know us again then I suppose !!
Catch 22 I think !
Regards Chris

Going to court is a worry but I doubt that the judge will side with HFC if you`ve been showing willingness to pay off your debts with a DMP,you can only pay what you can afford!
Just remember to take your new revised income and expenditure sheet and I think that the judge will probably give you a CCJ but this will only be an amount you can afford, just make sure you pay it if he does as otherwise HFC will try and get a charging order on your property."Life is short even in its longest days".0 -

Thanks for reading and thanks for the advice - what is a "charging order on your property" though ?0 -
We are on a DMP with CCCS and Nat West kindly gave us a CCJ even after we had just increased our payment, which they accepted. They originally threatened us with a charging order! The difference with a charging order just means that your creditors receive proceeds (if positive equity) after the sale of your house. If you have a number of creditors they may not be able to do this. Perhaps when you contact your creditors you could advise them that this may only be a temporary reduction pending an increase in work? This may prevent them from taking court action as if a CCJ is given then this is legally binding on both sides and it would mean that if you were able to increase your payments they cannot ask for anymore!!! Good Luck!Debt at Sept 2006 £63,500:eek:
