    No paid leave was offered in the first six years of employment, if you wanted a day off you took it off at your own expense. Yes, it is up to me to claim, but I want to know legally can I claim and for how many years?

    Its not down to a company to offer paid holidays. Its a legal entitlement for full-time workers as well as part-time workers to avail of a particular number of paid holiday in each year.

    I was wondering where I stood on the issue with being o na casual contract, which neither falls into full/part time.

    I know that the ACAS site tells you how to work out your paid leave entitlement if you do not work the same number of hours each week, and my understanding is that 'casual' workers have the same rights to paid leave as full / part-timers. ACAS might also have advice on what to do if your employer has NOT paid for leave in previous years.

    But I do not know if there are differences in employment law between NI and England. I am sure the ACAS site will say.

    I know paid leave is a right not a privilege. However, my two older sons have both done casual / very part-time work at the local cinema over the last 3 years. I have told them they are entitled to paid leave, but they have never claimed any. And this is the first year that their employer has said "Oi, you haven't taken any paid leave, book some now." It seems it's taken some employers a while to catch up with the legislation.

    Sorry to resurrect an old thread but I was hoping for some guidance similar to the original poster...

    I am leaving my employer part-way through the leave year. Details are as follows:

    Contractual entitlement - 22 days plus bank holidays
    Leave year start - 01/01/08
    Last day working - 29/07/08
    Days already taken - 8 days

    Could anybody please help me work this out? Do the bank holidays not come into the assessment at all?
