  • Help please. If money was left in a will to a non uk person living abroad would it be guaranteed they would get it?

    well the executor is bound to follow the terms of the will, so yes they should get it and can take action if they do not. Wouldn't say guarantee as such, and they will most likely get it bank transfer. The fact they are abroad makes no difference.

    Thought I better add this just in case. Assuming there are funds in the estate that is, if the person dies with debts that exhaust the estate then no they will not get anything. Also if you are talking in Scotland then you have the added factor or legal rights so there are reasons, legally, that there could be funds but the person would not get.

    What if the person who's will it is, is elderly and can't write properly themselves?

    Make sure that your will is written by a qualified member of (I think that it is ?) the Will Writers Association as not all lawyers or solicitors are capable of drawing up, understanding the implications & expressing exactly your wishes. This is an intricate job which needs specialist training. :eek:
