OR starting his work

I went BR on the 19th of December 2007. I had to call the OR a week ago to hear what was going on as no-one had been in touch. I have just now (29.01) received a brown envelope containing two forms I have to sign and return. The news that a face to face interview will not be necessary is very welcome but it's all progressing very slowly and the OR has made no request for bank statements etc. When does the OR do this? I assume a telephone interview will be necessary at some time? Or maybe not. My SOA is apparantly fine and my reasons for BR, if a little unusual, solid. So if the OR's office is very busy maybe I'll slip through without much trouble.

Anyone experienced the same?

    Mine is the opposit.I went b/c end nov,had statement requests a wk later,had phone interview on 12th dec,IPA forms recieved by me 23 dec,implemented on 29th jan(1st payment of 36)then letter from OR saying my file was being transferred to trustee last wkend.All that in about 8wks. I would say their office must be busy and that christmas has not helped. Perhaps they feel an interview is not nessesary. I am sure i read on the ISS wbsite that IF an interview is needed it can be either over the phone or at the OR office. Take a look and let me know if i'm worng.Dalip

    I would guess that your OR's office is snowed under at the moment and as you said everything is very straight forward they are probably using their energy in dealing with the more complicated cases.

  • That would be wonderful news if true. I'm sending the signed forms back tomorrow. But do some BRs get processed without an interview of any kind?

    I've never heard of anyone NOT having an interview of any kind, though telephone interviews seem to be the most popular choice.

    Usually when you receive the letter from the OR theres a pre-paid envelope that is for all your statements CCs etc. Was there nothing of they kind in with your letter?

  • if your term of BR starts from when the judge stamps your forms in court, personally id not worry if the OR was slow, can his feet-dragging cause a BR any probelms he/she hasnt already got?

    look at my case, no assets, no cash, no house, no property, a £200 car (OR can have it if he can get it to start) and im owed £300, my income is £150 a week, my outgoings almost match that.

    what exactly is the OR going to do to me?, they might WANT to have me flogged but the chances are its not gonna happen.

  • The letter you received from OR, does it say in top right hand corner 'LNI'? If yes this means Letter No Interview. The examiner has reviewed your statement of affairs and thinks an interview is not necessary. The OR reserves the right to request an interview later is something comes to light which needs furthrr info, but most bankrupts who get LNI's are never interviewed. these are cases where there are no assets to be realised, no IPA to be discussed, cause of insolvency is fully explained and debts tend to be relatively low or aged.

  • No, if no interview you dont have to send in any finanical documents. I woudl keep them all until after bankruptcy discharge. I would say between 5 and 10% of cases are no interview, for me anyway, a lot comes down to the examiners judgement.

  • I went BR on 12.12.07 and I had an interview on 3.1.2008 and I've been asked for nothing bank statement's wise. Do you think I will?
