admin charges on disputed account???

can somebody please clarify for me... i have an account with littlewoods which was passed onto their collections department NDR (national Debt Recovery) i sent off the first letter requesting CCA and they sent me a print out of what i should have received and signed and returned....in other words no signature of mine on there

I'm senind the second bog off letter tomorrow but they are still adding admin charges of 12 and 15 pounds on there

can they do this even though the account is in dispute?

    I'm not sure - it sounds very unfair but I don't know what the rules are. Hopefully someone else will be along soon who knows. Did they really think they would get away with sending you a copy of what you should have signed??!!

    to be honest they can do what they like but if they don't provide the info then they can't enforce the debt. send the letter. This is a favourite of Littlewoods and most vatolouge companies. No proof No payment!!!!

    How long is it since you requested the cca, Spaniel?

    hi rog, i requested it on 10th december, they sent me back a letter on 2nd jan with a copy of an UNSIGNED credit agreement that they are assuming i signed when i opened the account.


    this is what the letter says.


    Dear miss spaniel

    If a third party is acting for you please refer this letter to them

    With reference to your letter dated 10/12/07, requesting a copy of the credit agreement.

    Under sections 77 and 78 of the Credit Consumer Cedit Act 1974 we are required to provide a copy of the executed agreement (if any). On the assumption that you have signed the agreement supplied to you at the time of opening your account. We enclose a copy of our agreement, which complies with the requirements of the Consumer Credit (cancellation notices and copies of documents) regulations 1983.

    Simply NOT good enough, SPANIEL. They have no legal right to make the assumption that you signed.
    I will have a think and post a letter that you can send them.
