Telephone Harrasment

Hello, i have been receiving a lot of calls from a debt company called LINK, i have sent them a letter on NOV 29th 2007 as follows

Dear Sir/Madam
I am writing to express my serious concerns regarding the telephone calls that I have received from your company.
I am now formally requesting that all further correspondence be made in writing only.
I demand that these phone calls stop immediately. I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts.
If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
You will be deemed to have been served notice of my request and I will deem it served by November 29th 2007, I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.
Yours faithfully

i have received yesterday a voicemail from them asking me to call them and again today.
what action can i take against them, any ideas, they have even called me at my new job, as i found out they obtained the works number from when i called them in my break to provide them with an address to write to me, thanks in advance

You'd better show your familiarity with the PHA by placing it in the right decade (-:
From memory, it was 1997 or thereabouts!...much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -
You have threatened to report them to the OFT and to Trading Standards so this is what I think you should do. Actually, if I were you I would probably initially send another letter (enclosing a copy of the first) explaining I had recieved a call and restating that you were not prepared to be contacted in that way (ie I'd give them a second chance but I might be being too nice). Make sure you quote the names of people that have called you too if you have them.
If they still do it then you should carry out your threat and report them (no point making idle threats) keep a log of all the times you are called and any conversation that takes place and any voicemails you are left on ANY number. If you do need to make a complaint then you will have the info to hand.£34,547 (Dec 07); Current debt: £zilch (Debt free December 2010)

Good advice but don't give a second chance - would they? You can block the caller - look though the BT info or your line provider - for a small fee you can block a number. Don't know how this stands legally if a company tries tocontact you but if you've requested communication via letter then why do they need to phone?poorandindenial wrote: »Actually, if I were you I would probably initially send another letter (enclosing a copy of the first) explaining I had recieved a call and restating that you were not prepared to be contacted in that way (ie I'd give them a second chance but I might be being too nice). .
Good luck and I hope all is sorted soon - I hate these things - life is stressful enough as it is - then there is always something else to do because some small minded idiot gets your name from a mailing list - what happened to privacy laws eh?'Proud To Be Dealing With My Debts' : Member number 632

I have had all 3 (probably more to come i will be recording them all on my mobile) as these calls go to voicemail due to them caling while im at work and this states the date and time the message's where left, i have the option on my mobile to press record so i have called my voicemail and recorded all the messages and saved them to my mobile phone as MP3 files, i was thinking of writing them another letter stating the names of the people that had called me and at what date and time, and then telling them i am reporting them for harrasment calls. what would be the best address and name to address this letter to to report them0

To be honest i wouldnt bother they always give false names i remember when i had my debt crisis i kept getting calls from a mr duncan, miss lambert, mr anderson, and the best one was chris clerk , he was a man , a woman, an indian , a scott, a geordie , a scouser, nd one had sinus problems , i remember saying to one i spoke to chris clerk and he was a woman so you cant be chris clerk and when the bloke phoned i said vias versa they got very annoyed i remember that bit debts in the past
now but i can still look back on it with some amusement .0
