The IVA council

I'm two years into my IVA and since my payments kept getting increased, we've fallen behind.I recieved a letter this morning from the IVAC, telling me that I may have been missold my IVA and to ring them.If we have been missold, they can take action to recover some or all of the money that has been made so far, and will no longer have to make any payments.
Is this right, has anyone else had one of these? They know the date it went to court and the compony who are dealing with us. Should I ring them? I'm hoping It's not a scam.

Don't touch with a bargepole.
There is an official statement from the governments 'Insolvency Service' regarding them:
See: Insolvency Service statement regarding the IVA Council

I should also add that anyone can search through the publicly available Insolvency Register to find the name, address, court and date, and the details of the IP/firm that set the IVA up.
Easy to go here and search:

On a seperate note, if your payments have gone up and you are struggling, contact your IVA supervisor first.
Having gone through the long 5 years of an IVA myself, I always found it comforting to know that your supervisor is there to help you and to communicate to lenders on your behalf.
if your circumstances have changed, you may be allowed to bring your payments down to the originally agreed amount, or at least less than what you are paying now.
Speak to your supervisor and work through a new Income and Expenditure.
Hoep it all works out alright for you,and don't forget that there are people on the boards here who have been, or are in a similar situation so you are not alone.0 -
Thanks Balmk, It is comforting to know, that instead of feeling like I'm all on my own and ashamed, There are so many really kind people on here willing to help out. It's a life line of support, thanks again :beer:A clean house is the sign of a broken computer!0

An IVA is a legal form of insolvency.
That means the information must be in the public domain. It's something that isn't normally explained very well about IVAs.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
