Joint Credit Card with Ex , am I liable??

    Thanks Rafter,

    I was expecting all the previous posters on this thread to disagree with me as they all seem to think people are jointly liable for credit cards. They are SO WRONG!

    Always be careful you trust any person who you give an additional card to, because if you are the main account holder, YOU WILL FOOT THE BILL.

    I know of several people who have given partners (not husbands/wives) cards on their accounts and they have blown a fortune and done a bunk. The poor sucker who trusted them ended up with the debt. Don't let this happen to you!

    Ember, you are incorrect. HSBC T&C's state

    25. Should the Bank issue an Additional Card at the joint request of the Cardholder and Additional Cardholder, the Additional Cardholder will be bound by the Terms and Conditions of this Agreement and shall be liable for the use of the Additional Card, notwithstanding that the Primary Cardholder shall remain liable for the use of both his/her Card and the Additional Card and that the Bank shall have complete discretion in recovering charges incurred by the Additional Card from either the Primary Cardholder or the Additional Cardholder or both. In relation to Clause 21(a) above concerning cancellation of an Additional Card, the Cardholder may be liable for any payments arising from the use of the Additional Card until it has been returned or until the Bank is able to implement the procedures which apply to lost cards if the Cardholder so requests. The Additional Cardholder shall not be liable for the use of the Card by the Primary Cardholder or the use of any other Additional Card by any other Additional Cardholder.

    SSarah I am in exactly the same boat! Split up with my ex 5 years ago (what is it about 5 years!) and been divorced for two. At the time of the divorce paid my ex a large amount of money & told him to pay any debts from that. Quelle surprise he didn't bother his a**e, and I got a letter the other day that hes taking me to small claims court (him not the CC company cos they can't). He's also included an extra amount for "compensation". I'm prepared to go to court as it will be his word against mine. Even tho I'm scared I'm not going to let him beat me. So sarah take heart you're not alone and maybe its time to teach these a**holes a lesson!

    What is it about five years? Well, debts tend to get cancelled if they are not "acknowledged" after six years, so the fifth anniversary functions as a kind of alarm clock.

    Elvis girl, surely you can find some kind of evidence relating to your agreement (even just a bank statement showing the large payment to him)? Unless he is willing to tell a pack of lies in court AND is a convincing liar (remember that judges are used to hearing people lie) I think your chances are pretty good.

    Thanks for that Voyager. I have evidence (in the form of an agreement) but as my solicitor said "maybe thats just the sort of him". And yes he is probably prepared to tell a pack of lies (why break the habit of a lifetime!)

    This thread has put my mind at ease as my son had a card on his ex-girlfriend's account and I wouldn't have put it past her to spend, spend, spend (believe me she knows how to) and leave him to foot the bill.
