  • I was wondering if anyone could help, I have spent several years abroad, 5 and a half to be more exact. When I first moved I managed to rack up a debt with my bank, who passed it on to a debt company to "hunt down". When I moved back to the UK I checked creditexpert.co.uk to find it was defaulted july 2005. but had never contacted the company as I wanted to get settled in before contacting them. I noticed after consulting creditexpert that the defaulted debt has gone off their site. After looking online I noticed that the debt is "statute-barred" providing I havent contacted the company acknowledging the debt. They have recently been sending me letters at my new address for the money but as yet I have not replied. After reading about statute barred on the national debtine site, it says "Use this letter to help you dispute liability for a debt where a creditor has not contacted you for over six years and you have not made a payment or written acknowledging that you owe the debt during this period." Now I have not made a payment or contacted them within the 6 years of the defaulted amount. But they have sent me letters, does that mean I am not able to send a letter stating the amount is statute barred as they have contacted me, or am I still able too?

    think you may have to send them a statue barred letter. use that letter filling in the relevant details. good luck

  • In 2002/2003 (8years ago) I was 19/20 and stupid I ran up a lot of unsecured debt and ended up not paying it when the payments were far to high for my wage. I left england and only returned a couple of years ago and I want to finally move on from my young stupid days.

    What I want to know is how exactly does statured barred work? I believe it relates to no communication if so what is there definition of communication?

    How do I go about refinding(maybe 6-7 companys) and clearing the debts using stature barred?

    I have checked and to the best of my knowledge think that I have no ccj!

    However what would happen/the difference if I did have a ccj?

    I know its a whole lot of questions, any help would be much appreciated

  • If the debt is statute barred, it is statute barred, you don't have to do anything to make it so.

    Although you may have to convince a court it is statute barred should a creditor start chasing you.

    That you have no CCJ is very good news from your point of view, because a debt with a linked CCJ cannot be statute barred.

    No contact means what it says, so it seems to me your debt is statute barred.

    There are arguments as to when the six-year clock starts ticking, but no point in going into that unless you have to.

    I think your best course of action is to do nothing.

    As you might imagine, creditors don't like statute barred.

    Now you have returned to the UK, it is likely your name will pop-up somewhere, so a creditor or debt collection agency may start chasing you.

    They will try to convince you the debt is not statute barred, so keep the relevant information to hand.
  • A debt is SB from the date you last made payment, and it hasn't been acknowledged in writing for 6 years.
