A friend at the weekend asked my advice on a particular family situation.
It seem her grandfather died without leaving a will, he had 12 children who are all adults. He left a will stating that when the house was sold all the money should be spilt between ALL his children. Unfortunately, two of his children lives abroad. Well the house was sold but the and the money was divided up between the 10 children living here, the two living abroad got nothing. How can my friend ensure that her parent received the money they were due to them. The whole thing is shrounded in secrecy and she only found out by chance that her parent had missed out on his inheritance.
She has the address of the house sold, is there anyway she can find out who dealt with the sale?, or her grandfather will?

Did he leave a Will or not?
I would try contacting the Probate Service to find out who administered a Will and what it contained.0 -

i assume that her parent was one of the 2 children living abroad!smile --- it makes people wonder what you are up to....:cool:

sorry for being confusing.
HE DID NOT LEAVE A WILL. AS I UNDERSTAND IT, HIS WIFE DIED BEFORE HIM. AT HIS WIFE'S FURNERAL HE TOLD HIS CHILDREN WHEN HE DIED THEY WERE TO SHARE THE PROCEEDS OF THE HOUSE BETWEEN THEM. OUT OF THE 12 CHILDREN ONLY 10 GOT THEY SHARE AS THEY LIVE IN THIS COUNTRY. THE OTHER TWO WHO LIVE ABROAD WERE LEFT OUT.

If he didn't leave a Will, he died intestate and therefore his estate should have been distributed according to intestacy laws.
As I understand it, this would have meant that someone should have applied to administer his estate and have in fact done what was suggested at the funeral - divide it equally amongst all his children.0 -

Problem is they have all clammed up. Someone in the know told her what was going on. I said she should confront the family, but she wants to know what rights her parent and the other family member has before doing anything.
