DF leaving for a new job - is he entitled to holidays?

Hi there,

I hope someone can help with the query. I have searched the internet and can't get the info I need.

My partner is due to leave his current job for a new start in a new job at the end of the month. The holidays for this company is 20days (which works out as 1.66 days/month). His last day at his current job is 25th of Jan. I was just wondering if he was entitled to any holidays? If you work it out as weekly instead of monthly then he should be entitled to 1 day. Does anyone know if he has to work a full month to build up any hols? His boss has said she doesn't think he is entitled to anything but I just wanted to double check.

    I assume 20 days is the allowance for a full time person working Monday to Friday? Are bank holidays paid in addition? When does his holiday year run from?

    Does he have a booklet or letter detailing his Human resources info? One job I worked at paid hols by month, and it was detailed that you didn't get hols for a part-month worked. Terms and conditions or contract of employment would be a good place to start. No reason why he couldn't approach HR "around" his manager.

    He is entitled to holiday pay even if he worked a morning then left but it is calculated at a "pro rata" rate which is roughly equivalent to 8% of basic pay.

    I did less than 20 days ad hoc for an agency over a 3 month period and still got holiday pay when I left which worked out just short of 2 days basic pay.

    Is that 20 days PLUS bank holidays? If it is, fine, if it's INCLUDING bank holidays then it went up to 24 days last October, so he might be entitled to a bit more.

    Doubt if it's worked out on a weekly basis if they're paid weekly!

    absolutely correct, Conor, most wages dept know this too and automatically add it in on leaving, but always best to check!!
    may work out a little bit more even, as the entitlement went to 24 days in Oct 07(provided he not on better obviously)
