Anyone work for Tesco

hi, my sister started at a new Tesco store just before christmas she has had 3 wage pks now, none are right and no one not even the supervisors can work out the wage slips , they have had her last one 2 weeks now and she also worked 5 nights overtime in the last month and got paid 2 hours more than the previous month but the supervisor told her she thought it was right , eh! how can 5 nights at 3 hous extra a night total of 15 hours work out the same as the month before, she does not even want to do it but as she is so shy and soft and not worked for 16 years as she is a single mum bringing up the kids , she was forsed to find work from the dhss ( i said she was just lazy myself)so she feels that speaking up for herself she is being cheeky and a trouble maker . as being her first job for years , also she gets paid single time they said to her for overtime , I said i wouldent do it , also some days she starts at 8am and it 2.30pm 3.00pm before she gets her first break , i told her it was againt the law to work more than 4 hours without a break . and that is usually her only one she might get another 15 mins one if she is very lucky in an afternoon she is there from 8an till 6pm well thats if they let her clock of on time as i go to pick her up from work and am still sat in the car waiting at 20 past 6 somtimes .does anyone else wor for teso and find all these problems about overtime payment breaks and wages please

Ask the manager (or do it yourself) for a written breakdown from the wages clerk showing what days/hours you worked.
The breakdown isnt always easy to read, but make sure you are shown clearly what the days/hours you have been paid for.
You need to raise the issue ASAP, did you join USDAW when you started? If not, join them now because if you cant get anywhere with the managers then you would be best going through the union.
Regarding overtime - you only get the overtime rate when you work over full time hours (think its about 36).
If she is working longer than her shift is supposed to be she should ask to be paid for it or get the time paid back to her by getting away early or starting late.
Breaks - You are right in that a break should be given if a shift is 4 hours or more, but it doesn tneed to be given within the 4 hours. I cant remember how far in to the shift Tesco actually states they will give a break but it is written down within Policies For Our People which is the tesco "rules and regulations". Each store should have a copy of this that any member of staff can request to look at.

tesco doesn't pay any over time rate any more even if you work over the 36.5 full time hours. They are cutting rates as much as they can they only pay time and a half on a sunday now when it used to be double. They may only pay time and a 1/3 now since I left.
It sounds like your sister is being taken advantage of. I used to work for tesco, and in a place like that theres no need to stand for it.
For the payslip its best to go to the personnel office, they will help her out. Also tell your sister to write down all the extra hours she works throughout the month so she can refer to it when things go wrong.
If she does a 10 hour shift that means shes given an hour an hour unpaid break isn't it? Thats how it used to work when I worked there.
So that should mean one 15 minute break after 2 hours.
An hour break after a further 2 hours.
Then the last 15 minute break 2 hours after the hour one.
This will leave 2 hours left until the end of the shift.
Thats the way it should work out. Obviously it doesn't and changes depending on what needs to be done etc but she should stick as close to it as possible. If she doesn't already, she shouldn't wait for permission to go on a break, she should just go on it and on the way just tell someone right im off on my break, see you in a bit.
If she goes in at 8am and doesnt have a break until about 2pm then I bet loads of other people are coming in after her for a 4 hour shift, having a break half way through and then go leave at 12, while your poor sister wont have a break for another 2 hours!
As for leaving 20 mins after her shift - why does she do that she doesn't get paid. On the dot she should leave. Ofcourse if theres a lot to do and someone asks nicely for her to stick around for 10 mins then she may want too. But if shes continously leaving this late she should just clock off on the dot in future.0 -
hi thanks so much for your replys very helpfull , i will show her these replys , yes she does work form 8am till 6pm 5 days a week and she does have a one hour dinner break, what she clocks out then in for , she is on the hot deli counter cooking and serving coustomers , and is the only person on there so has to wait for someone to come and take her of for breaks, when i go to pick her up of an evening i ask her how many breaks she has had today , sometimes she says my dinner hour and one other 15 mins break but not all the time she gets the other 15 mins break as they are either two busy or short staffed , i go mad at her , and as for not finnishing on time its because she hasnt had time to clean all the ovens with having to stop and serve all the time and she is not allowed to go till the ovens are spotless clean , thats what holds her up , im just on my way to go for her now and am late thanks a lot again0

Ah I can see how it would be a difficult being on deli counter. If they are short staffed and she carries on missing breaks and working late then the least they should do is pay her for the extra time. Its not fair on her, has she spoke to anyone about it?0

Tesco may be required to give additional breaks on Health and Safety considerations if relevant but the Working Time regulations do not require breaks every 4 hours.
If an adult is required to work for more than 6 hours a day, then they are entitled to a minimum 20-minute break. The break is meant to be around the middle of the work session but it is not regulated exactly when - other than that it should not be at the end of the session.0 -
As far as I'm aware, she shouldn't be working so many hours. Working 8 am - 6 pm 5 days per week works out at 42.5 hours per week after breaks! The company should pay extra for any hours worked above 36.5 anyway - I have been told that this is paid at time and a quarter. In addition, as any overtime she worked is above this amount it too should be at time and a quarter, unless it was on Sunday or Bank Holiday when it should have been at time and a half.
Tesco staff have the right not to be left any more than 4 hours without a break. I understand it's really hard on the deli but the issue should be raised with the section manager; also, about not finishing on time. In my store, wage queries are dealt with by the section manager to start with [not a supervisor]. I recommend a list of ALL hours worked is kept - tick off each shift that has been paid - the easiest way to keep on top of it all!
If you don't get anywhere then I recommend USDAW - they can give you advice and, if there are still problems, deal with the problem on your behalf, e.g. phoning the Personnel Manager. It only costs about £1.80 per week for full timers.
