Credit Card Charge Claims

Hey all

Will I still be able to claim charges back even if i no longer have an dactive credit card with said company?

I.e. I had an Egg card but paid it off in full a year ago but I am sure I was charged for going over my credit limit at the time.

Can I still make a claim ??

    Just want to post my experience ...

    I had a "Direct Line" (RBS) credit card, which was included in a Trust Deed from 2002 to 2005.

    This year I wrote to them to correct some details on my CRF with regard to settlement and, instead of reading my letter and responding to this issue, they immediately sent me a letter offering a goodwill refund of the charges I had paid in the past!

    So I said "thank you very much and while you're at it, can you also correct these details ..." !!!!!

    I was most surprised that they offered the refund without my even asking - so good luck everybody else!

  • Yes you can, you can claim back up to 6 years worth. As long as you've got your paperwork with your account numbers etc you can write to them and request your 6 years worth of statements and then put your claim in.

  • So I paid off all my cards in full each month cos when I signed up i knew they'd hit me with charges if I didn't it being a clause in the contract, which i read before signing up!
    Consequently I have little sympathy with anyone that suffered any charges.

    There was a reason they were punitive to stop users racking up debt they couldn't afford duh!
  • OK Just looking at your questions within this forum and I've got some answers for you all

    Andyw76: Yes you can claim on closed accounts, this applies to bank accounts too, but the sooner you put your claim in the more you can get! As it was pointed out on the show and on the webcast (http://www.itpaystowatch.co.uk/shows/show-2) you can claim 6 years of charges (5 years in Scotland), this is due to a clause in the contract law. So the sooner you find out and the sooner you get the statements, the more of your potential charges can be claimed back. 8% interest over 6 years on £10 equals £4.80 interest ;) Follow the links off Channel 5 site or from here to find all the template letters and even an interest calculator (I did :D)

    Yes you will have to pay for your statements if you do not have them BUT (here's another good legal bit) under the data protection act the maximum you have to give them is £10 for ALL the past 6 years of statements, not £5 a page they would like to charge you. Again there is a template letter to do this and they have 40 days to send them to you. Some send your £10 back as they don't charge, but thats it, £10+ a stamp and you're on your way to claiming.

    deanh22: Circumstances change, I always paid off my debts, but 1 month I was paid late, this incurred charges on my bank account, the charges snowballed and snowballed until I was being charged more in account fees than I was getting paid. When a single bounced standing order for £3 costs you £25 and you still have to find the £3 when the bank has taken all your money, it is very hard to do. And once the bank has made you overdrawn they put a nice big black mark against your name so you can't even borrow £3 to pay your bill! If my bank had loaned me just £100 when all this started then I would not have had to run up the debts I did and find myself facing ever increasing charges. Fortunately I was able, over a few years, to repay all my debts and then I found out I could get all the charges back ;) so I did! :)

    You need to start by reading Martin's article here...

    Send off the first letter (SAR request) asking for all information held on you and enclose £10 for this information. Should you not have your account number you will need to send your name, any relevant addresses you may have used while you had the card and your date of birth so they can trace your account. All banks can and do charge for copy statements this is why you must use the first letter and ask for the information required under the Data Protection Act.

    Once you have the list of charges or the copies of your statements you then need to follow Martin's article and put any late payment fees and/or over limit fees through the Interest Calculator and work out your claim and send off the second letter in Martin's article.
  • just joined.. and about to start claiming back based on my banks (awful) behavior this week..

    got all my statements back to 1993 from them a few months ago (but didnt pay for the privilege' .. I've always claimed they needed to repay me the money, since on my long conversations with them they have stated that teh money was for 'admin purposes' and to 'send me letters or ring me on late payment of my account' something that they have never done..

    I assume it wont harm to mention that fact in the letter I send them.. As another user on here will testify (shes marrying me!).. I'm like a dog with a bone if someone does something wrong :) and I intend to get every penny back from them...

    the bank is Natwest.. and thus far I havent worked out how much they owe me.. but i suspect quite a bit :T:T

    Hi All

    I have just received my statements from egg going back 6 years so I need to go through and pick out all my charges, there must be £100s

    My question is can I do anything to get money back for what they call credit card payment protection?? In some cases it creeps up to over £40

    Any ideas?
