Money Dilemma

Hi All,

I think this is the right place. I have ordered goods form an on line retailer and them paid with my mastercard. The goods were incorrect and were returned and I asked for and received a refund.

I still received statements showing i was due a credit and I informed them I was not and to close the account. They are now telling me there system they have refunded me again and that they want the money back. I can't find any trace of their second refund on my credit card statement and I have even sent them a copy.

They are now threatening me with court, changing me fees and interest. I could pay them off but it is the principle. I have never signed a credit agreement with them.

Could the take me to court? I live in Scotland and the company is in England. Would i!have to travel down to defend this and pay costs? Is so I would be better off paying them off.

All thoughts appreciated.
Thanks
Jack

  • I'm pretty sure hey can't take you to court if there is no proff that they refunded you twice. By the sounds of it they f***ed uo and are trying to scare you.

  • Who is sending you statements - the online retailer or your credit card company?
  • It's the retailer, however i have just recivied one showing they have refunded it twice. Their statements are a mess....
  • You need to see the statement for the card that it was refunded on to. It is all well and good them saying on their statement that they have given it to your card twice but if your card statement doesnt say it then it clearly hasnt.

  • Haha - No way. They are trying to make you pay a refund for something there is no evidence of them ever giving you. It's like me asking you for £50 because i say so. If I haven't given it to you then you shouldnt have to give it back. Call your bank and check the statement from their pov. It may also take up to 7 days for the refund to show which is why they are saying that you have it but you cant see it. If they continue to go on i would advise seeing the CAB. Go with your statement and explain. They will stop harrasing you when they realise your not taking any bull :)

Just one thing to consider - are you checking the correct card statement?

Ring your CC company just to double check and also ask for a fresh statement just in case.
  • Nope it is the correct card and it is well over the 7 days. I might tough it out.... whats the worst that can happen?
  • Exactly - if they take you to court (which they wont) they will more than likely be laughed out and told to pay costs. Hold out. You shouldnt have to pay for something you didnt get. If you give them the money then you are paying for th eitem that you returned!
