Direct Debit Dates Changing

Ive just recieved a bank charge for my bank not paying a direct debit due to insufficient funds. The thing is; the direct debit date is the 5th of each month - when there would have been enough to cover it. However, the company came calling on the 10th - when there was enough to cover it. DO they have any right to be able to change this date by 5 days??? The direct debit guarantee says they must notify me in writing, but the company says they collect 'on or around' which is pretty vuage and i think 5 days is too much. Do I have a case to get my charges back???????:confused:

    You state that on either date there would have been enough money to cover the DD. So why should you be charged anything?

    If there wasn't enough on the 5th, then 10th is probably the second time the company tried to collect.

    If there was enough on the 5th but not on the 10th when the company tried to collect, what happened to the funds in the meantime? Did you just spend it even though you knew you owed the money? Are you simply not keeping a sensibly close eye on your funds?

    If you are referring to January 2008, then, as the 5th was a Saturday, the nearest working day was Friday 4th. Did you have cleared funds in your account at the beginning of 4th January?

    You must have cleared funds in your account the day before the DD/SO goes out. Is that the case ?

    I would think 5 days afterwards is quite within the definition of on or around, particularly if there's a weekend involved. 5 days BEFORE I would start quibbling.

    direct debits are one of the services you can get from a bank. Never have I had a problem and the vast majority do not.

    It is not the fault of the direct debit that you dont have enough money in your bank and it gets bounced. The same bills would then need to be paid by cheque (which would bounce) or you would need to go into the bank to get cash which given your "plenty of times" comment probably means you would be rejected.

    Your issues are to do with lack of money and living beyond your means I'm afraid and not direct debits.

    The reason is because you and the OP are blaming others and or very good systems for your mistakes
