    No, they've already established that this was unlawful

    The case isnt to decide the legality of the charges, its to determine if the charges fall under the Unfair Terms..... - if its decided they do, then the OFT can decide on the legality itself.

    As for needing to write to banks, the OFT could also order the banks to refund customers any charges applied.
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.
