How can I cancel the order?

My husband ordered a christmas present, via an internet based company, he ordered it well in time for christmas, and it appeared to be in stock at the time he ordered it.
They took the money off his credit card straight away after the order was placed.
He still has not recieved it, hes just told me that after several emails to them, they have replied saying they currently have none in stock and will get round to sending one when they have one, but dont know when that will be!!
As we have not recieved it, and now its well past christmas anyway, do we have a legal right to cancel the order and get a full refund?

If they have not sent it within 30 days of order,(unless agreed to extend this time), SEE HERE "Goods must be delivered within thirty days unless agreed otherwise;" you do have a legal right to cancel under Distance Selling Regulations.
You can also return them , without reason, for 7 days after receipt,( you may have to pay return postage costs),.

Didnt need to bother, email from company today they are cancelling the order as they can no longer get the item and will refund the credit card!0

Would the above apply to a friend of mine who purchased some pc parts before christmas from a website and they apparently posted them but he hasnt received them yet,No Links in Signature by site rules - MSE Forum Team 20
