hi all
me and my girlfriend found a house we loved last august and due to us not being ready etc we let it go and it was sold. however the sale fell through and it came back on the market last week. :j. we know the lady that owns the house and she does want us to have it but before i could speak to her another family have put a holding deposit down on the house
but still have to sell their own house.
now the point of this thread is to ask if there is any way i can move in and make an offer for the house and still get it or do i just have to hope it falls through again.

just put an offer in via the EA.
after all you are (I presume) in a position to move,.
if it's only the new sellers who have placed a holding depoit EA can simply return it if the vendor agrees.0 -
Could take ages for the other couple to sell so the holding deposit thing should only hold it for a period of time not forever. Can't hurt getting your own offer in anyway.0

Until they've exchanged contracts, either side can pull out at any time with no explaination. A holding deposit is usually just something the Estate Agent gets to check the buyer is serious, and not part of the legal process.
If she wants to sell to you, no one can stop her. If the Estate Agent didn't introduce you to her, then she won't have to pay the Agents fees either. Usually you would have to offer more than the other party though (i.e. gazump them).0 -

If I offer more for a house than you after you have agreed to buy that house and my offer is accepted, I have not gazumped you. the vendor has.

#1. The people that run these "sell your house and rent back" companies are generally lying thieves and are best avoided
#2. This time next year house prices in general will be lower than they are now

I'd speak to the vendor directly to make sure that she's aware of your offer, ESPECIALLY if you were not introduced by the current EA (ie the EA now is different to the one in Aug) as they will have a vested interest in getting the vendor to hang on for the other family to get their commision otherwise.They deem him their worst enemy who tells them the truth. -- Plato0

I would also point out your position to the vendor I.E if you are first time buyers or allready sold stc you are procedable and in a much much sronger position than the people who have put a holding deposit down.
if that is the case i dont think you need to necessarily put in a higher offer as your position in the market place would be very good bargining power.
I am i the process of selling and will "politley" not accept offers from people who cannot proceed as it could take a long long time.0 -

Sorry, I know about property, not run a dictionary shop. You will have caused them to be gazumped; is that better? However when you say 'again' you just mean that you think I'm wrong on the property front because you don't know what you're talking about. Or are simply trying to find minor grammatical errors, rather than concentrate on the nuts and bolts of the issue that the person wants help with. Who exactly does that help?
And if your refering to the discussion on yield, that's because you are fundamentally wrong as I've explained.

Yes, you seem to be clear on the gazumping now.
However your calculation of yield on the other thread above is incorrect.

i spoke to the vendor today and she has been offered £115,000 by the other couple but she said i can have it for £113,000 regardless of estate agent fees etc.
so if ive understood everything on this thread she can pull out of the other offer at any point and accept my offer by not going through the estate agents as i have not been in contact with them.0
