E Bay items not arrived,,,

I ordered some items from E Bay,and they were posted from Ireland on December 5th 2007.
I waited for them to come,and they haven't yet.Caught my postman,asked him 'Does it normally take this long?' He said 'No' and gave me a card to get in touch with the Post Office.
I looked on web,it involved a long questionairre involving payment etc,and not knowing what my E Bayer paid,I got in touch with her and asked her...She said she would send me out another order.Good.

But surely this is not the point?

If my parcel goes AWOL for whatever reason,who is responsible for the loss?

I am lucky that I have ordered before from her,and she is sending me a replacement,but it is cheesing me off that the parcel has gone missing.

Edited to add that it was a 2nd class parcel post with no insurance.

Ant ideas?

    Firstly ask the board guide to move this to the ebay and other auction sites board (see my signature) as you'll get more response.

    It is always the sellers responsibility to ensure you receive your parcel and your seller has done the right thing by sending a duplicate item. However I am not quite sure what you really mean by that not being the point?

    Whilst the seller remains responsible they cannot physically track your parcel inch by inch through the system nor can they guarantee that the Royal mail won't do something terrible with it en route. Likewise yes, the Royal mail should ensure that all items reach their destination, but unfortunately they also admit that sometimes things go astray, it happens to all of us. Therefore the seller can use her proof of postage to make a claim, at a later date from the Royal mail.

    Incidentally if your replacement item does not arrive or if in the future any seller refuses a refund or a replacement then you can always start a paypal chargeback, assuming you paid that way. However a chargeback is always the last resort and should only be started after the seller proves to be un coperative.
