Bankrupt and car finance...wont take the car back

Ok heres our story

Hubby went bankrupt in August 2007 we rang the car finance company b4 and told them he was going bankrupt ( we have had the car since 2004 but been on lower payments of 126 per mth ) They said they would be collecting the car or we could carry on paying at 126 per month which we cannot afford so we said No come and collect. Sept i rang again and was told the same they will come and collect, Oct told same.Then on new years eve i rang again and they again said they will collect the car, i offered them £500 final payment ( they wont get anymore through auction as car has no mot or tax and needs quite a bit of work, they said no i would need to settle finance at £9000 car was only 4995 when we bought it but of course interest on top. So we are still waiting for this car to be picked up, the trouble is where i live we have allocated parking spaces and this is causing hassle with neighbours as it is taking up a space which is not ours. Does anyone know where we stand with this? It either needs to go NOW or let us keep it at a full and final payment. The company we had the finance with was Welcome finance but it changed to some company in Motherwell once we stopped paying. We have not made a payment on this car since Feb 07 yet we stil have it in our possession, we dont drive it as Tax and Mot ran out in Nov we did drive it until then though.

  • Hi ya I had the same trouble with welcome, I havent gone br but in an IVA. Welcome are part of the iva but still insisted on going through court route etc etc even though they hadnt issued default notice and basically they screwed up at their end anyway when i got into initial financial difficulty i contacted them and they offered me aswell lower payments and keep the car i said no i cant afford it take it away 2 years later the car has not been collected. And was left at my old house which they are aware about, because all the time i expected them to come and reposess the car back but never did. In the end i have since found out that because the car was not taxed etc that the DVLA/council have seized the car and crushed it lol so now nobody has it. Have not heard from welcome since but am sure welcome will rear their ugly underhand heads sonner rather than later....the maniacs should have collected the car when they said they would 2 years ago.:D

  • Thanks for the reply, the silly thing is we would love to keep the car, so its just sitting there rotting and its an ok car. Needs work but still good. Why dont they just either collect it or let us keep it how silly!!!!
    I dont understand the no collection bit??? i would have thought they would have collected straight away so they cn get as much money as poss for the car. Well if it is not collected soon im sure DVLA will get involved already had police round it as it has been reported as left. I told the police the circumstances and they then said it was our problem and responsibility until welcome picked it up
    ARGHHHHHHHH hitting a brick wall here lol!!!!
  • Welcome have got to be close to the top of the list of Worst company to ever deal with. I personally would cut your losses let the dvla scrap the car and go buy a cheap car that they cant bloody get their grubby little mits on lol Throughout all the stress that welcome have ever put me through i have to laugh that the dvla have scrapped the car lol as i said nobody now has the car. As for welcome collecting the car, they dont want the car it cuts down profits etc for them to pay someone to collect put it right and sell at auction for peanuts. THey bank on those that mess up on payments wanting and needing the car. once they know your not dependant on it they dont seem to bother other than just chase the money you owe. I have read other posts and understand trading standards have loads of cases going on with this company.

  • so i should just leave the car? Trouble is i cant leave it where it is right now, i am only allocated 1 parking space and we are about ( saturday) to buy a cheap runabout with my nhs student loan so we will need the space ourselves. So i dont know where to put the car till they decide to pick it up. Thats if they ever pick it up lol.
  • Jen. have you written to them terminating the agreement ? have they issued default notice? if the answer to this is yes, do you have breakdown cover? mmm i heard of someone who had breakdown cover and got the car towed to the nearest welcome finance office put keys through the letterbox lol yes they then technically have their car back then and no need to worry then about whether the car is then going to be collected lol god i wish i had the balls to have done that, but an idea for you all the same! Then you free your space up you dont have to worry about police knocking at your door etc etc just an idea xxx

    I think Watchdog have done a programme about these people. They certainly have done a program about something similar and they took the car to the qffices.

    Not sure about the legalities of this. Why don't you give Debt Doctor a PM and ask him to look at this thread. He might be able to tell you the best course of action.

  • In one of my HP agreements I had a "handback" clause, basically, after half the payments had been made i could just give the vehicle back to the HP company, so i did....

    but it was Black Horse

    I would definitely get some legal advice. If it isn't taxed and its on a public highway you could be fined. Take Tigerfeet's advice and pm debt doctor or give CAB a ring. At least you'll know where you stand.

    Also, let us know what they say, I'd be interested. I have a car on HP and have 8 payments out of 60 left and haven't paid since June 2007. I'm not sure where I stand but the car is taxed, MOT'd and in my driveway (I still use it everyday).

  • I will be interested too , currently going through a HP arrangement too ,,they did not reply to my last letter pre-xmas about very low payment for foreseeable future or maybe a full and final payment based on what my family is willing to put together.
