Is it "5 or more" or "6 or more" rented bedrooms in a shared house that requires minimum of two shower/toilet rooms?

When is an HMO cert required in terms of bedrooms is it 5 or more?

When are firedoors required?

When you buy a house over 125K is the stampduty payable on the full value of the house i.e. 130K or only on the portion above 125K i.e. 5K?

  • Re HMO - it's probably best to check out your local council's website for the up to date regs.

    Re SDLT - unfortunately, it's payable on the full purchase price not just the amount over. Nice try though! :)

    Stamp is payable on the full market value of the house at the appropriate rate.

    Eg A flat with market value of £125,000 will have stamp payable of £0. A flat with market value of £125,000.01 will have stamp payable of £1,250.

    Mandatory HMO licensing applies to shared houses which are 3 or more storeys AND five or more occupants. Number of bedrooms is irrelevant, it's number of occupants that matters.

    The rules regarding washing facilities vary between England and Wales. If you're in Wales I can tell you that if you have five occupants then one bathroom (with or without a WC) and one separate WC and WHB are required. For six occupants two bathrooms (the second one may or may not contain a WC) and a separate WC and WHB are required.

    If it's 3 storey (and if it's mandatory licensable it will be) then most doors will probably need to be FD30 and a whole load of other means of escape stuff will be needed too.

    Some councils may apply other selective licensing schemes to, say, 2 storey houses. Best to call them and check.

    HMO regs are not about "occupants" they are about "households" - ie families. look on your local authority website.

    Sorry but that's not correct in the case of licensing, although in most cases an occupant IS in effect a household. Number of households is important regarding the definition of HMO in the first place though. It appears to be licensing that the OP is questioning.

    At the top of all the licences I've issued it states that the licence is valid for "x" number of occupants. No mention is made of households.

    "Households - ie families" is not 100% correct either, although in many cases it will be.
