Please Help Loan Advice

Hi. First thing i would like to say is im new to this site so if i get it wrong please dont shout at me ! and the second thing is thank you all for being so knowledgeable and helping all the people you do.

My Problem - I had a loan with egg which went into default a few years ago. i set up a repayment plan and was paying it off. When i check my balance it had gone up with a unknown charge ?. The account was passed on to a collection agency which i refused to pay until they produced a credit agreement and statement. To cut a long story short i have wrote to several different collection agency's who have been dealing with it asking for credit agreement and also Egg who the loan is with. None of them have produced it one company even told me Egg have lost it !. I wrote to Egg direct asking them mark the account as £ 0 balance and to clear my credit file as i have repeatedly asked for the Credit Agreement with no reply again !. I dont know what to do now ??? PLEASE can any of you good people help. !

    Peter,

You cannot walk away from your debt just because they cannot locate the credit agreement. The fact that you paid the loan before it went into default is evidence enough that the loan existed and should be paid.

You should write to Eggs data protection department and request a complete record of the information they hold on you, including a cheque for £10.

At least then you will be able to see your records and any charges that have been applied to your account.

You can then decide whether to make them an offer to settle or decide how to repay what you owe if your situation has now improved.

Smile :), it makes people wonder what you have been up to.
  • Thanks for your reply i do not want to walk away i just want someone to tell me where the charge has come from. I have sent a number of letters in the format you say, they have never cashed the cheque nor do they reply. Just want to sort it out. I have spoken to various debt organizations and they say just keep writing. Seems a waste of time will now be the 8th recorded delivery letter i would have sent. Dont know where to go from here ?????
