  • Thank you to Rog2 and RAS for your quick replies, I feel better having read them. I am presuming that Red Debts letter of the 18th Jan has crossed with the one I sent them on the 16th of Jan so hopefully when they get a copy of that letter with the one I sent them today that will be the end of it.
  • Ah, this happened to me and I did the same. I hope its the last we both hear about it. I just waited til today to send the letter as that was the 12+2 cut off for me, so no matter what, they've done wrong now.

    Fingers Crossed for us both. :p

    I just had an unpleasant exerience with Lowell about a debt thats not mine. They have claimed to be representing T Mobile. The whole amusing story can be read here:

    But I have a question, here someone said I should not sign a letter if I write to them1 I have written and signed. !!!! I only said "Please find attached proof from T Mobile that my account needs to be closed and that they will not be pursuing this debt blablah. and then I said Please remove the default from all my credit reports and send me written confirmation of this. (and I attached proof).

    Why is it bad that I signed it? I am scared now.....

  • It has been known for your signature to be 'lifted' and copied onto legal documents which are then waved in front of you as proof that you owe money, not that I am suggesting in any way that this particlar company would resort to such underhand tactics;)

  • Have had a reply to my previous letters to lowell re alleged debt to barclaycard from 1993.

    Should I reply or ignore. I feel like they have just left me hanging and yet they know this debt is statute barred. I have never asked them to prove the debt exsists as we have never had any correspondence on this and they openly admitted that it related to a debt from 1993 so they would not be surprised if I knew nothing about it. Really unsure as to if I should reply reiterating the statute barred legislation.

    There is absolutely no need for you to reply - you have told them that you do not acknowledge any debt to them, and that you will not be paying as the account that they are referring to would, even if it were genuine, be statute barred.
    You need do no more. Lowell hope that you will reply, as this implies that you are still uncertain and, therefore, there is still a possibility that they may, by continued harrassment, get some money out of you.
    Just keep the letter with your copy of the statute barred letter. If the letters, or calls, continue, you can report them to Trading Standards, using these letters of evidence that Lowell are, indeed, harassing you.

    If you know you did not sign anything, then if it went to court, you demand the original, which can be proved to be forged.

    Ok thanks. T Mobile have deleted "my" account, they dont have records anymore. nothing...

    Do companies , when this happens, pay back to the debt collection agency the money for which they ahve bought the debt?
