Anyone help me with a self assesment question?? Please !!

Hi all,

Never posted on this board so hi again !

I also may well be posting my question in the wrong place so feel free to move me elsewhere.

I need some help with self assesments in 2006 April(ish) I think I decided I was going to sell shoes on ebay buying them new to sell on found a supplier and thought yeah I can make a go of this so registered it with the tax office thing is after registration it never happenned work put me on an NVQ which took up alot of my time my gran became very poorly and was in hospital until her death in early July and I then discovered I was pregnant yes an awful lot happenned and it never even got started.

I of course received a tax return I rang and explained what had happenned they told me I must still complete the return and file it or I would be liable to the fine it is a legal document blah blah so I did that explaining what had happenned by 31st Jan last year.

I then received a letter from the tax office dated 12 March 2007 which said I will shortly receive a tax return for the year ended 5 april 2007 however due to information provided on my return for 5th April 2006 that they would not insist that I complete it. It also states they are ammending my tax records to show this information however should my circumstances change then I would be required to file it.

End of story......

Not quite today I got a letter dated 17th december 07 stating that the final deadline for my tax return is 31st January should I fail to return it I will be fined so I ring and ask them what is going on the guy tells me it is a legal document and as such must be completed or they wont close it down I explain about the letter he refuses to acknowledge it just repeats the legal document rubbish.

So who do I listen to the letter or him tbh he did not seem to have a clue what I was on about I have no tax return here to even complete so if I have to fill another one in how do I get one I have not got a clue what I am supposed to be doing any advice will be most gratefully received I struggled awfully with the last one.

Any advice??

Thanks in advance

Strictily speaking, if you received a SA return or a 'notice to file' then you have a legal responsibility to complete and return it by the deadline.

Having said that, if you still have the letter that you mention and would prefer not to complete the SA return, send a copy of the letter with your own covering letter advising them that you won't be submitting.

    Thanks for that Hoddie,

I am still in posession of the letter I mentioned and will do what you suggest (glad that I kept it now thought it may come in usefull) Although it states in the letter that I will get a return I never received this so I am not actually in posession of one.

    Thank you again

You can only be fined for not submitting a tax return if you owe tax, and from what you say it appears you don't, but Hoddie is right in advising you to write to the Tax Office explaining the situation enclosing a copy of the letter you received. [Keep the original!] It's always best to put things in writing and keep copies of all your correspondence.

Tax Offices are sometimes slow to process their mail, so write as soon as possible, and don't be surprised if you get another reminder or even a demand for the £100 fine. If there is no reason for you to have to complete a return, they will eventually accept that they shouldn't have sent you the reminder.

    hi Poppy

    just a thought.........

you could also send in a NIL return with your letter, that might save lots of correspondence going both ways for weeks and lots of aggravation to you over the next couple of weeks when the Tax Office will have more delays than usual until 31 January

you can download a pdf Return here

if you decide to do that and need any help please PM me anytime
