Moorecroft returned debt to PayPal Credit

Hi

I have been on my DMP for about 3yr now, I requested the CCA from all of my sold debts back in December 2025.

Moorcroft was unable to provide a CCA for my Paypal credit account so I stopped paying them around March 2026.

Fast forward to now, they have passed the debt back to Paypal on 1st October 2026. I have received a letter from Paypal requesting payment.

Shall ask them for a CCA or is there no point as they are the original debt?

should I just sent the details to my DMP so they can add it back?

If you don't ask you'll never know, so ask!!

Moorcroft likely requested it but it wasn't provided hence the pass back. So chances are Paypal won't be able to provide it to you either. Don't pay unless they can come up with something credible.

PayPal is the original creditor, so they aren't legally required to provide a CCA for a running credit account in the same way a debt buyer is under a section 78 request. The usual tactic of using a missing CCA to stop payments won't work here. Your best bet is to send this straight back to your DMP provider so they can add it back to the plan and deal with PayPal for you.

Hmmm, you make a CCA request only once, if the creditor cannot comply with it, then the debt remains unenforceable until they do comply, however long that may be.

Moorcroft will only have been acting as collector here, they should have passed the request to PayPal in order to action it., I`m guessing they failed to do that.

So, what you should do is remind PayPal of your request, that you sent via Moorcroft, do not send another one, as there is no need.

For the avoidance of doubt, the onus is on the original lender to supply a copy of your credit agreement, usually within 12 working days, but that timeline is simply for guidance.

In most cases a debt buyer or DCA acting on behalf of a lender, will have to resort to passing your request back to the original creditor, in order to obtain compliant paperwork, as most lenders retain this information in-house.

This is not correct. s78 requests apply to the current creditor. In the case of a debt that has not been sold, this is the original lender.

It is not uncommon for the original lender to be able to produce CCAs for very old debts. Especially store cards or debts that defaulted a long time ago. .

Paypal is an interesting case as depending when the account was opened, Paypal may not have had a UK lending licence, but have been relying on EU authorisation. It would be interesting to see what Paypal produce when asked.

Someone has nothing to lose by asking Paypal for the CCA.

thanks for the heads up. I’ll be letting them know that I requested the CCA when the debt was handled by Moorcroft to see what they say
