AIC CCA Requset Reply
Hi all,
I have been doing my self managed DMP now since last year for around 54k in debt. Mostly cards but 1 loan also. I have got to the point where they have all defaulted me, passed them to debt collectors and been paying £10 a month. I have now written to them all to request CCA's sending the standard letter.
The first response i've had back is from AIC who have my Natwest CC or so I thought.
Their reply says that their client asks that this request is set out in a certain format for example 'copy of the original agreement under section 77/78 of the consumer credit act 1974. and that my request is signed with the customer reference number quoted.
The letter I sent did have the paragraph:
'I understand that under the Consumer Credit Act 1974 (sections 77-79), I am entitled to receive a copy of any credit agreement and a statement of account when I request it. I enclose a payment of £1 which is the fee payable under the Consumer Credit Act 1974.'
I did quote my AIC reference number but not my Natwest ref as I assumed it had been sold on. I did not sign it.
Is this a delaying tactic or do I need to sign the letter? Also, I thought Natwest had sold this debt so why do they say their client has requested?
Should I reply just adding the customer number? They also sent back my £1 postal order in a seperate letter saying they no onger required a fee.

If ACI are referring to "their client", then they are only acting in the capacity of a collector, and have not been sold the debt, if the debt had been sold, you would have been informed in writing, as per law of property act 1925, under which these things are regulated.
Possibly they are being a tad pedantic, but if it was a credit card account, then its sec 78 that applies to credit cards, sec 77 applies to loans, and sec 79 to hire purchase agreements.
You should sign a letter as a matter of course.

That looks like the standard National Debtine CCA request template.
It sounds as though AIC are collecting for Natwest. Is this credit card very old? Unless it is very old, there is little point in asking for the CCA as Natwest will be able to find it.
How are your finances now? A year ago you were focussed on the lease car ending and possibly having to move.0
