HM Courts Claim Form from DCB Legal/Parking Eye
Hello.
Received Claim Form 14 August 2026 following unsuccessful appeals in 2023 based on Edna Basher's template for lease cars.
2023 appeal:
(…You will no doubt be familiar with the strict requirements of Schedule 4 of POFA to be followed in order for a parking operator to be able to invoke keeper liability for a Parking Charge. There are a number of reasons why Parking Eye's PCN did not comply with POFA; in order that you may understand why, I suggest that you carefully study the details of Paragraphs 13 and 14 of Schedule 4 in particular.
Given that Parking Eye has forfeited its right to keeper liability, please confirm that you shall now cancel this charge. Alternatively, should you choose to reject my challenge, please provide me with details of the Independent Appeals Service (POPLA), their contact details and a unique POPLA appeal reference so that I may escalate the matter to POPLA.)
14 August 2026 Claim Form Particulars:
1. The Defendant is indebted to the Claimant for 3 parking charges issued to vehicle … (leased vehicle) at …
2. The dates …
3. The Defendant is pursued as the driver of the vehicle for breach of the terms on the signs (the contract). Reason: Vehicle Remained on Private Property in Breach of the Displayed T&Cs.
4. In the alternative the Defendant is pursued as the keeper pursuant to POFA 2012, Schedule 4.
AND THE CLAIMANT CLAIMS
1. £510.00 being the total of the PC(s) and damages.
2. Interest a a rate of 8% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereoff at a daily rate of £0.04 until judgment or sooner payment.
3. Cost and court fees (total £799.16)
Grateful for your advice on how to defend, which elements of which defence templates.

With an issue date of 14/08/26 and providing you complete(d) the AoS before or on 02/09/26 your defence deadline date is 4.00 p.m. on 16/09/26
Use the latest template defence and adjust your paragraphs #2 & #3 accordingly. You have to refute what the POC claims you did wrong. Given the poorly pleaded breach, you can use the defence template that links to Chan & Akande

You've condensed the POC wrongly.
It does not give three dates does it?
(Of course the link to the Chan & Akande version in the Template Defence are up to date).

Of course. Like I said, that's not specifying three dates, is it? Seen this loads of times.
There are endless defences which are like yours, and you know to use the Chan & Akande version linked in the Template Defence thread (for cases where the breach is not pleaded). Just add a sentence somewhere sensible, to point out that the woeful POC fails to even specify three dates, let alone hint at any specific breach allegations.

Hello. I've missed the AoS deadline of 2 September (I assume this is a 14 working day timeline). I am able to submit tomorrow 6 September. Is this a hard and fast issue or Is there a mechanism for an extention of AoS on the basis of not having seen the POC because of being on annual leave, etc? I can prove I have been travelling with a flight boarding pass etc.
Probably the parking companies choose to send POCs in August or Xmas to try and catch people out.0 -
ASAP - Check MCOL - your Claim history. Is there a default judgment recorded? If not quickly get your AOS submitted.

For the benefit of others: Acknowledgement of Service - Guidance Step 1 of 5 says the following (my bold annotation), as my AOS was filed today after the 14 day window:
—Each step is completed by clicking 'Next' at the bottom of the page, which automatically confirms and saves the information you have entered. Any error messages displayed at the top of a page must be corrected before moving on to the next step.
Before you acknowledge service of the claim against you, which gives you time to seek advice to complete your defence, you must make sure the following apply in your case:
- you are filing your acknowledgment within 14 days of service of the claim on you (a claim is considered served on the fifth day after it is issued) or
- you are filing your acknowledgement within 14 days of service of separate more detailed particulars
If you haven't filed an acknowledgment of service within the time specified above, the claimant can request judgment against you.
However, if the claimant has not already entered judgment against you, you may file an acknowledgment of service up to 28 days after service of the claim (or separate particulars) on you.
You don't have to pay a fee to acknowledge service of a claim. If you file an acknowledgment of service electronically through MCOL, you don't need to send a copy by post.

In my case there was no default judgment served after 18 days, so I think I've got through the AOS and can now prepare defence.

Yes, some bulk litigators don't necessarily want a default CCJ. It doesn't magic up the money for them and they are more successful at getting paid at mediation.
