CCA request reply
I put in a CCA request back in February to Moorcroft regarding my MBNA credit card. I’ve today received paperwork that starts Backbook customer copy template MBNA credit card term and conditions customer copy….
The address in it is current not the address when I took out the credit card and my surname has changed in that time too. Also under your credit limit it says - your credit limit is £0. This is the maximum you can borrow under this agreement.
Doesn’t seem right so wanted advise? Thank you

The anomalies you report would not automatically make the debt unenforceable.
The debt will only be unenforceable if the creditor cannot produce a legally compliant credit agreement, see below:
What Makes a Credit Agreement Legally Compliant
A credit agreement is legally compliant when it includes the following essential components:
- Written Agreement: The agreement must be in writing, providing clear terms and conditions.
- Interest Rates: It must include transparent interest rates, including APR, and any applicable fees.
- Cancellation Rights: The agreement must specify cancellation rights, including the period within which the customer can cancel the agreement.
- Cooling-off Period: Customers must be given a cooling-off period to review the agreement before making a payment.
- Rights and Obligations: The agreement must clearly outline the rights and obligations of both the lender and the borrower.
These elements ensure that the credit agreement is not only legally binding but also protects the interests of both parties involved. It is crucial for businesses offering consumer credit to ensure compliance with these requirements to avoid legal issues and maintain good standing with consumers.
The name/address/credit limit/signature are not required to make a copy credit agreement legally compliant.

The Carey case is clear that an address has to be provided:
https://www.bailii.org/ew/cases/EWHC/QB/2009/3417.htmlThe following is a brief summary of the principal findings and conclusions set out above:
(1) A creditor can satisfy its duty under s78 by providing a reconstituted version of the executed agreement which may be from sources other than the actual signed agreement itself;
(2) The s78 copy must contain the name and address of the debtor as it was at the time of the execution of the agreement. But the creditor can provide the name and address from whatever source it has of those details. It does not have to take them from the executed agreement itself;

I will give you that, the HSBC v Carey case is a long read at 235 paragraphs.
I guess the OP can challenge them on this, but it could be easily remedied if they still have the original address details, if they don`t, they you may have an argument about enforceability.
