CCA letter advice or do I just continue to pay?

Hi my first post.

So I've got two old credit card debts that are currently with Cabot (shows as wescot credit services) and Moorcroft, it was a time I had a failing business and through sheer pig-headedness and burying my head in the sand, I thought I could rob Peter to pay Paul to sort the business, which obviously didn't happen.

I've been looking at Consumer Credit Act letters but I'm not too sure if I'm wasting my time.

My current debt with Moorcroft (which was a tesco credit card) is £6076.08 and I've paid off £1,500 since august 2025 and I pay them £150 a month.

My current debt with Cabot/wescot credit services (which was a MBNA credit card) is £2,036 and I've paid off £1,800 since August 2025, and I pay them £150 a month.

Obviously, I am paying them, but I've been reading up that potentially it's something that I might not have to pay. Obviously, what I was going to look to do was to approach them with a settlement as well. I just want to make sure I'm doing things right, but also, if it's something that I can potentially wipe out, that would obviously be great.

I've got the draft letters ready to go for the CCA from the National Debt Helpline template. I'm just after some advice on whether it's even worth doing, and if it's not worth doing, if it's something that I can't kind of wipe out, is it worth approaching them for a settlement?

Thanks in advance for any helpful replies.

It can't hurt so why not go for it? Worst that can happen is that they come up with the CCAs. And if they don't then you can tell them it's all unenforceable.

Have the debts defaulted? Is there interest/fees being charged??

Always worth doing, at worst, it will cost you a couple of £1 postal orders, at best, your debts may be unenforceable.

Send them and see what response you get, just don`t expect a quick fix here, it can take time to locate paperwork, although the consumer credit act allows 14 days for compliance, expect it to be 6 months or more.

Whilst they are looking for the paperwork, the debt is temporarily unenforceable, if they can`t produce it at all, it stays that way, but, they can re-constitute a copy agreement using information held on their systems, however if no such information exists, they cannot just make it up.

See how you get on, and feel free to ask questions about this as it progresses.

  • they defaulted yes.

As far as I’m aware there’s no interest

Many debt collectors/creditors regard a CCA request as a "dispute", even though it isn`t really, so most accounts go on hold.

So no, you don`t have to pay during the period of unenforceability, and if they can`t comply with your request, you won`t need to pay at all, ever again, and the debt would simply go statute barred eventually.
