    hi all ,

I stumbled across all of this by chance thank god ! asking for cca ,I have been in debt on some cards since 2003 -2010 26k , I’ve been with stepchange on and off . Never ever have they or debtline I spoke to yesterday ever mentioned about cca . Some of my debts have changed hands 6 times I noticed and over the years have offered me massive discount, unfortunately couldn’t afford , which leads me to thinking do they actually have the cca available at all ?
I’ve spent so much time on this now realising pre 2007 need to be originals and that even newer are so difficult to source etc

Im with capquest ( who are 6 th purchaser ) link and cabot who have held 2 of my debts since 2016

At present I have just sold my property and scared they may do a back door ccj quickly to stop my application for cca

Before I send off requesting any further help would be much appreciated

Best to start a new thread, as the one you tagged onto was 2 years old, so I have done that for you.

If a lender wants to take you to court, they must provide evidence of your liability, that normally means a copy of the credit agreement, no one can just apply a CCJ, it has to be obtained, and without any evidence of liability, they cannot do that.

So if a lender cannot provide a copy of your agreement, under sec 77 CCA, they are prevented from taking legal action against you, that is the whole point of using sec 77, as the debt becomes unenforceable.

Sec 77/78/79 CCA may soon be repealed or altered by the Government, so best to act sooner rather than later.
