Is this a "letter before action" from Mortimer Clarke
Hi all.
I have received a letter from Mortimer Clarke Solicitors in which the header states:
"We have been instructed by Cabot to take legal action as you haven't paid your debt, you need to contact us to avoid a court claim being issued against you."
They "offer" two options, pay in full £2316.02 or pay by instalments.
As some of you may know, I have actively defaulted on my unsecured debts due to insufficient income and so have been dealing with the likes of Cabot, Link and Lowell for over 6 months.
Mortimer Clarke have had a recent SoA from me with explanation of my financial circumstances but it has obviously been ignored.
How best should I deal with this latest letter?

Is there a document for you to fill in, to ask for further details etc, with a 30 day return window?
If not, its not an LBA.

Some parking firms are just directing you to the statutory forms on their website which I think is non-compliant. But this doesn't sound like a LBA to me

Thanks guys. So just a typical tactic as per usual. I'll respond as appropriate and see what they do.

If this was a loan, credit card or HP agreement, I suggest you ask them to produce the CCA agreement for the debt. the law is being changed and this may not be so easy in future
