CCA Request

I have paid down all my debts over the last 18 months but have 1 remaining that keeps going round in circles. It’s been through at least 5 different collection agencies, each time I request the CCA, it gets put ‘on hold’ and then I hear nothing, until another agency gets hold of it and it’s a repeat process. I’d kind of just like to pay it, but also the stubborn side of me says why should I settle for what the debt is, rather than the pence it’s probably now worth.

Has anyone had a similar experience? The account defaulted in May 2024.

Thank you 😊

I'd keep stonewalling. If they can't provide the documentation then they can't have the ££. You might send a letter to them to say that as they haven't provided anything you will not be paying anything and if they continue to harass you or sell the debt on to someone else you will be reporting them to the ombudsman.

It's unenforceable under one law and in 4 years will be unenforceable under another. The only way they can change that status is by coming up with a copy of the agreement. It doesn't sound like they can do that

As they haven't produced it then it's unenforceable so I'd just keep quiet until they do, if that ever happens. Even if they admit they cant produce it then it often won't stop them pestering you or making settlement offers. PRA admitted my account was unenforceable but after that they phoned me every other day and sent weekly emails for about 18 months before they got bored.

You only request a CCA once, if they fail to comply with that request, the debt remains unenforceable until they do comply, however long that may be.

It might be a good idea to stop the "rinse and repeat" approach, ignore anything but a court claim, and just allow time to do its thing.
