Hi all, I posted yesterday but havent received too many replies and think perhaps my post was a bit long so i thought maybe i could ask the questions i really need answering without all the spiel beforehand.
Bailiff has put 'Notice of Seizure' on a £7k car for a debt of 1400. They have threatened to take within the next couple of days unless full debt paid which i havent got.
Firstly can they do this and if so what will happen to the excess amount?

sorry I'm not sure either but you are in the right place for advice.
There are agencies/charities around that give specialist advice on this kind of thing. They get mentioned on these boards quite a bit but I don't know what they are off the top of my head.

I don't know anything about this topic but i would have thought that if you could give them part payment they would postpone seizure meantime ?!?!?!
I don't know what they would do with the left over money but i'd be surprised if they offered you any back

Hi,
I would advise you to park your car well away from your home until you ring the National Debtline and get this sorted. Whether the bailiffs legally can take the car, and whether they vvill take the car and argue the toss later, may be two different things. Just to be on the safe side, make it unavailable to them. From the little I know, they are under no obligation to get the value of the car if they put it to auction. They could just let it go for peanuts, or aim to cover the debt outstanding plus their fees.
If they call to your house, do not let them in.
Phone the National Debtline as soon as you can and get the accurate information you need.

As soon as you talk to the National Debtline, you should feel a lot clearer about how to deal with this.

I think they auction cars for a lot less than they're worth and charge you a fortune for the cost of removal. You should move your car well away(not just up the road) and try the citizens advice bureau for advice, they have people who can help.

what is the history with repayments? Have you made any attempt to pay the debt of regularly.? Do you need the car? Can you sell it privately and pay off the debt then downsize?
As well as dma advised above, contact the finance company and find out their side of the argument.
My main advice would be look at what you can afford to pay back then make and offer (along with first payment to show sincereity and desire to pay).DFW 228 LONG H 68

HIDE THAT CAR QUICK........There must be someway round it rather than them taking the car and virtually giving it away and charging you for priviledge :mad: .

I was making the payments but i thought they were monthly but they were in fact weekly so therefore payments were missed. Was my own fault really for being so careless.
The car is definately needed as my husband has to travel alot for work. I have emailed the company on friday offering £320 a month which i can realistically afford but i got a generic reply saying i would get a proper response within 5 days (They couldnt deal with it over the phone at the time as was out with the bailiff)
Im not duisputing the debt or am i refusing to pay but its just getting it sorted in time and with the threat of the car being removed hanging over my head im in a pickle as what to do.
I thought they could only seize goods to cover the value and possible that there were rules about taking excessive goods but maybe im wrong.

By the way the debt is for council tax (just incase amyone thought it was a finance company for the car) - the car is owned outright0
