Appeal against inclusion in MTD?
I have a feeling this might be wishful thinking but….HMRC have roped me into MTD because a one off payment last year kicked me over the MTD threshold for property income. My property income has been way below the threshold for the last 10 years and will be again this tax year. I'm not self employed. It looks like I'll have to submit 3 years of quarterly returns before I fall out of MTD which is to put it mildly, annoying in cost and time terms. Has anyone managed to challenge inclusion in MTD because of a single payment last year?

I can't imagine there is a route to appeal. The rules for inclusion seem clear.
I also can't think of many ways a LL would have one-off income affecting the requirements. Was this an advance rental payment?
If so, is your normal income above £30k? You will then be in-scope from 2027.

There isn't an appeal mechanism. You can only escape MTD once all sources of income potentially within MTD cease, or you stay under the limit (which falls to £20,000 from 6 April 2028) for three years.

There is a Money Box live podcast, released a couple of days ago. It'll still be on BBC sounds. They had the guy in charge of MTD, and people calling/texting in questions.
Appealing was discussed, and he gave the figures of how many have appealed, and how many of those have been successful. I think it was 70%.
So there definitely seems to be a process.

Yes, but not on these grounds. There are loads of exceptions to MTD, like if you might make a farmer's averaging claim in 2026/27.

It was a Rural Payments Agency grant for a one-off project. Usual property income as reported to HMRC for last 10 years is a long way short of the MTD threshold

Hi, I hope that our comprehensive guidance on MTD (which HMRC referred to in the BBC Moneybox programme), will help you confirm your position: https://www.litrg.org.uk/tax-nic/making-tax-digital-income-tax/when-can-i-stop-using-making-tax-digitalThanks
