All trademarks used are the property of their respective owner(s) and areused for prize description purposes only.1.2 In the event this Promotion is run via one or more third party platform(s), the Promotion isnot linked to the third party platform(s) and is not organized, endorsed or administeredby, or associated in any way by the third party platform(s). All entries must be received by theOrganizer before the end of the Promotion Period and meet all the eligibility requirementsdesignated below to be eligible to win the Prize All entries received after the PromotionPeriod are automatically disqualified.23. ELIGIBILITY3.1 In order to enter this Promotion and be eligible to Win the ‘Japanese GP Giveaway’promotion, You represent and warrant that You satisfy the following eligibility criteria:- You are a natural person 18 years of age or older at the time of entry. Any translations are provided as amatter of courtesy only.3.6 The Organizer will not accept entries that are: (a) automatically generated by computer; (b)completed by third parties (on Your behalf) or in bulk; (c) illegible, have been altered,reconstructed, forged or tampered with; (d) incomplete; or (e) late. Upon notification, the provisional Prize recipient will be providedwith details on how to claim the Prize and will be given 2 days from the date of contact to4claim the Prize, unless a shorter time frame is required by the Organizer in which case thiswill be communicated to the provisional Prize recipient at the time they are contacted by theOrganizer. In the event that Youare a Prize recipient You agree that the Organizer may disclose Your last name, residence,in accordance with advertising laws in the United Kingdom.5.6 Physical prizes will be delivered by DHL or equivalent national or international deliveryservice, to the address provided by the winning participant. Organizer accepts noresponsibility or liability in for any delays, damages or other issues with delivery. Themaximum delivery term shall be no longer than 60 days from the end of the Promotion orthe date of the Prize claim. You should checkour website regularly for any changes which will apply from the date that they areuploaded.6.3 At any time during the Promotion, the Organizer reserves the right in its sole discretion todisqualify and/or remove any participant if it has reason to believe that where voting isused as a selection process, anyone voting for such winner has been paid, incentivised orpressured in any way for placing their vote, either by the winner or any third party and/orthe participant fails to observe these Terms, is engaged in cheating, or where applicableany other kind of illegal or inappropriate behaviour. DISCLAIMERNone of Formula One World Championship Limited, Formula One Marketing Limited,the Fédération Internationale de l’Automobile, Organizer, Visa, Cash App, or any othercommercial sponsor of the Visa Cash App Racing Bulls Formula One Team, or any oftheir respective parent companies, subsidiaries, affiliates, directors, officers, professionaladvisors, consultants, contractors, legal counsel, public relations firms, employees andadvertising, fulfillment and marketing agencies (collectively, the “Released Parties”)will be responsible for: (a) any late, lost, misrouted, garbled or distorted or damagedtransmissions or entries; (b) phone, electronic, hardware, software, network, Internet, orother computer or communications-related malfunctions or failures beyond Organizer orthe Released Parties’ reasonable control; (c) any Promotion disruptions, injuries, losses ordamages caused by events beyond the reasonable control of Organizer or the ReleasedParties by non-authorized human intervention; or (d) any printing or typographical errorsin any materials associated with the Promotion.11. LIABILITY AND WARRANTY11.1 Notwithstanding anything to the contrary hereunder, by entering this Promotion, You agreeto release, discharge and hold harmless Organizer and each of the Released Parties fromany claims, injury, death, losses, and/or damages that may occur, directly or indirectly,whether caused by negligence or not, arising out of, or relating to, your participation in this7Promotion or any Promotion-related activities (including, without limitation, if You are thewinner, Your installation and use of the Prize, if applicable, or its redemption and enjoyment)and the acceptance and use, misuse, or possession, redemption, performance, experience ofany prize awarded hereunder (including, without limitation, any misrepresentation made byYou in connection with the Promotion; any non-compliance by You with these Terms; claimsbrought by persons or entities other than the parties to these Terms arising from or related toYour involvement with the Promotion; acceptance, possession, misuse or use of any prize orparticipation in any Promotion-related activity or participation in the Promotion; anymalfunction, error or other problem arising in connection with the collection, processing, orretention of entry information; or any typographical or other error in the printing, offeringor announcement of any winner). The foregoing includes, without limitation, any claim forpersonal injury, property loss or damage, or death arising in any way in connection withthis Promotion.11.2Insofar as is permitted by law, and without limiting the operation of any other clause inthese Terms, none of the Organizer, its employees, agents or distributors and the ReleasedParties will not in any circumstances be responsible or liable to compensate the Prizerecipient or accept any liability for any loss, damage, personal injury or death occurringas a result of participation in the Promotion, or taking up the Prize. Your statutory rightsare not affected.11.3The Organizer, and the Released Parties exclude all liability to You for any loss of income,loss of profits, loss of goodwill, loss of data, loss of opportunity (in each case whetherdirect or indirect) and any indirect or consequential loss or damages incurred or suffered byYou in connection with Your participation in the Promotion or (where applicable) in taking upthe Prize.11.4The Organizer, and the Released Parties shall not be liable for: late, lost, delayed,damaged, misdirected, incomplete, illegible, or unintelligible entries; telephone,electronic, hardware, or software program, network, Internet, or computer malfunctions,failures, delays or difficulties; errors in transmission; Prize notification deliveries attemptedbut not received; any loss suffered by anyone who enters or attempts to enter and/orparticipate in the Promotion, whether the entry is lost, not submitted, wrongly processedor does not win.11.5The Organizer may cancel, modify or suspend the Promotion should it not be capable ofrunning as planned for reasons including but not limited to tampering, unauthorisedintervention, fraud, dishonesty, technicalfailures, or any other causes beyond the control of the Organizer which corrupt or affectthe administration, security, fairness, integrity or proper conduct of this Promotion.11.6There is no legal right to participate in this Promotion. The Organizer, and the ReleasedParties are not responsible if You are unable to participate in the Promotion for any reason.811.7Subject to clause 11.1 the Organizer, and the Released Parties are not liable for thefollowing:11.7.1 any ruling or direction of the FIA and/or F1; or11.7.2 if You injure Yourself while performing actions with regard to this Promotion. Yourepresent that You do not have any condition and are not affected by anycircumstances that would prevent You from safely participating in the Promotion,redeeming the Prize or would pose a present risk to others in Your doing so. Youalso agree that You are not otherwise prohibited from participating in thePromotion or taking up the Prize for any reason.11.8In no event shall the Organizer, or any of the Released Parties and the Red Bull Group beresponsible or liable for:11.8.1 any failure or delay in the performance of its obligations under these Terms arisingout of or caused by, directly or indirectly, circumstances beyond its reasonablecontrol, including but not limited to strikes, work stoppages, accidents, or acts ofGod, and interruptions, loss or malfunctions of utilities, communications or computer(software or hardware) services, when these circumstances constitute a force majeureas defined under applicable local law.11.9To the fullest extent permissible by law, no conditions, warranties or other terms apply tothe Promotion and all free products are awarded "as is" and without warranty of anykind, express or implied (including, without limitation, any implied warranty ofsatisfactory quality or fitness for a particular purpose).11.10 The Organizer excludes any responsibility and/or liability in case theparticipation/the award of a Prize requires the approval of a Guardian. This solelylies within Your responsibility.12. GOVERNING LAW AND DISPUTE RESOLUTION12.1 1 Any disputes arising under this Promotion and/or these Terms will be governed by the laws ofEngland. The Organiser will try to resolve any dispute with an entrant amicably and in good faith. NO AFFILIATION WITH SOCIAL MEDIA CHANNELSUnless otherwise specified, this Promotion is in no way sponsored, endorsed or administeredby, or associated with any social media channel (i.e., Instagram, Facebook, Twitter, etc.) orany other named or depicted people or entities other than Organizer. Any questions,comments or complaints regarding this Promotion should be directed to Organizer.14.
