So does that get automatically done now they know my father has passed away or do you need to apply for that? If you need to apply how do you do that?

On the contrary, that was one of the first things I said in my first post on page one.
In this case, as OP's father left the LGPS before the crucial date of 1 April 2008, the scheme rules will only permit payment of a survivor's pension to a legally married spouse. No ifs, no buts, and no trustees discretion.
The discrimination case you quoted is another matter entirely, and is of no relevance to the OP.
