Please wait and see if you can get the form signed, we have told you debt collection is a slow process and you don't need to tell your creditors anything at the moment, you can ask to only be contacted in writing and whatever you do if you do pick up a phone call then just put the phone down and block any numbers you get calls from.

As I have said you must remember you are in charge not your creditors.

The General Data Protection Rules came into force some time ago, under those rules you can choose how a company can contact you, all you have to do is send a simple letter stating that you want all future communication to be in writing only, and they must comply with that, or face quite severe fines from the ICO.

So that`s all you have to do on that score.

Really appreciate your free continued, (and calming) advice. . . . .I suppose I'm just keen to get the process moving in a way as don't see much point in money being taken from my bank much longer if it's unnecessary. But yes I have a bit of time the next few days and will endeavour to do the SOA, and contact GP. Thanks again. . . . . Time for another 12 hour Nightshift, unfortunately !

Good, just don't panic. If you can't afford to make any payments to the unsecured debts just stop paying them, that will stop the money coming out of the bank.

Nothing will happen quickly, keep saying to yourself ' I am in charge not my creditors'

There is no reason for the doctor to not sign a D&MHEF if you do have problems that have been acknowledged even if there is no test to make it official. And it doesn't cost you (assuming you're in England) so there's no reason to not try for this. It may help to take the form in yourself to talk to the doctor so there's an understanding.

As for breathing space….it's a great thing when you have lots of threatening letters and bailiffs at the door which is nothing like what you've described so far. (and with your situation bailiffs are almost completely not going to happen so don't panic). That's the time to get someone to put it in place for you, but there's no reason for you to not ask a creditor for breathing space (they know the term) even if it's not an official version. But if/when it happens it will be 60 days so you can get yourself organised.

There is no 90 day breathing space. There is a mental health breathing space which is what you might be thinking of. With that you would have to be in an absolute crisis situation (hospitalised in a psychiatric ward etc) and the BS would last for the length of the crisis and then 60 days after that. So if the crisis lasted 2 years so would the BS + 60 days.

And so if you can't afford things stop paying but do keep with your priority payments - those are the ones that keep a roof over your head - rent, council tax, gas, electric, water (but even those may be flexible) & of course food. The rest are just icing and can be ignored if necessary - credit cards, loans, catalogues, and similar.

Take things one step at a time and keep coming back to ask questions.

Really sorry to be a nuisance again . . .the wah I am is I really need to understand everything.quite diligently . . . .

I am stuck on 2 things in my mind :

One.is in a way now I'm regretting selling the investments because I feel having money in the bank, although classed as "savings" will prompt my creditors to say I can afford repayments and not freeze interest. Or they may go further and demand the whole lot.

I hear people saying it's nothing to do with them but won't they request that information ?

My argument is that I can't pay all of the.13 creditors what I owe, for very long at all given when it's all gone I'm stuck with absolutely unaffordable payments and then I have nowhere to turn and need some savings for that event.

But how does that stand up. Can somebody be a little clearer of if that information is requested and what the creditors will say.

Also, a couple of the loans I took out as consolidation loans and unfortunately I didn't end up using them for that. 2 years old or longer now.

Can any of this be deemed as misappropriation or anything like that.

Because yes I am saying I can afford the repayments but will they just turn around and say well actually clearly you can for at least a temporary period anyway and insist my interest continues as a consequence at the very least .

Deep apologies for yet more stress from me.

You creditors have no right to ask you to show them any details about any savings accounts.

It doesn't matter what you spent the loans on.

Remember what I keep saying, you are in charge not your creditors and don't tell your creditors anything about your finances.

Thank you again. Yes, I keep second guessing myself (that will fade). Yes ,I remember even stepchange telling me to keep the savings. As an emergency fund. Apologies. Talk tomorrow thank you.

  • no major insights from me other than to suggest clearing the £100 cc and closing it. At least you will reduce post and/or emails by one a month. I do think you should also get the details on your secured loan.
