Your solicitor does not seem to be very competent at estate administration, was this the conveyancing solicitor? All that should be needed to transfer the property to the buyer was probate for your father and a death certificate for your mother.
Nothing from your father’s estate should have been included in her probate figures unless they actually held the property as tenants in common rather than joint tenants. Even if it was TiC probate was still not needed for your mother’s estate, but by applying you have created a public record showing that her estate was not insolvent which the finance company can access.Would I pursue this on principle? No it just lengthens closure and your sibling just wants to move on.
