Contact from Moorcroft Before Default
Hi,
My Aqua CC debt has been passed onto Mooorcroft for collection, but the letter states that Aqua have not yet registered a default and may not if I can offer a suitable payment plan.
At this point my plan is still to wait for all debts to default and ignore anything before that happens, should I still continue this now though that Moorcroft are contacting me regarding the debt or should I tread more carefully and make contact with an offer to pay what I have worked out I can afford on my SOA?
Thanks

You want a default, so ignore this self-serving offer that you could avoid one by offering a suitable payment.

Thanks for the quick response, I do not need to be any more concerned regarding action from Moorcroft than I would do from Aqua themselves then? Stick to the plan as business as usual.

No one can take legal action until the default is issued.
If you've have not made a mistake, you've made nothing2 -
I would be less concerned about contact from Moorcroft than the lender!
Also have you made an affordability complaint to Aqua/Newday? You have won some others in the past1 -
Yes I was successful with a complaint on this one, I received approx 3k back from the claim on a 4.8k balance so there is just the remaining balance sat on there now.

As has been noted many times on this board, Moorcroft act as collection agent only in debt related matters, they are usually assigned the debt prior to it defaulting, in order to get the debtor back on track with their payments.
Moorcroft do not own the debts they chase, so can take no action against you whatsoever.
All they can do is write to you and ask you to pay, nothing more.
You don`t want to be engaging with anyone prior to the debts default, as that just delays the process, once defaulted, you can then fill your boots and make whatever arrangements you want, with whoever then owns the debt.

When you won the affordability complaint, what did newday say about your credit record?

That they would remove all negative markers associated to the successful complaint from my credit file.

Nobody can take any legal action until the debt has defaulted so carry simply carry on ignoring until it has. Companies like Moorcroft often word things very creatively to try and scare you into paying. "Further recovery action" is a typical phrase, obviously chosen to try and create thoughts of court and bailiffs (which are impossible at this stage), but all it means is that they will write another letter, big deal.

How long would it take you to clear this balance if you start making affordable payments?
