That's good news for the OP and what I expected regarding my contributions. As my NI statement says that I can't get a higher SP with more contributions (under current regulations) I won't apply to pay Class 3. The OP should definitely keep pushing to pay Class 2 retrospectively if it will increase their SP benefit.

And so we beat on, boats against the current, borne back ceaselessly into the past.
  • I fired off an email to the DWPlast night. This is their response…

« We have received your CF83 from HMRC, but we require further information to assess your eligibility to pay class 2 Voluntary Contributions. Class 2 contributions From 6 April 2000 Class 2 NI contributions became cheaper than Class 3 NI contributions. If you want to know if you can pay contributions from April 2006 at the cheaper Class 2 rate, reply to this email, with all of the following information:

    • So that we can decide if you can pay the cheaper Class 2 contributions please also provide evidence of your employment / self employment since 2006 (letters from employers confirming your period of employment, annual tax/earnings certificates, wages slips, copy of contracts, certificate of self employment registration, letter from your accountant confirming periods of employment/self employment etc)

Once we have received the information from you, we will assess your entitlement to pay class 2, »

So they are requiring proof that the HMRC do not request I.e. beyond all the names and addresses of employers and dates of employment… Why? This seems so unfair when HMRC do not ask for any of this. I suppose I’m going to have to get everything out although it will all be in French so that is bound to complicate things…

I believe for overseas class 2 the decision around eligibility is not the remit of HMRC but of DWP through the IPC. Different to the domestic criteria where HMRC would have the necessary information available.

Never associate with idiots on their own level, because, being an intelligent man, you'll try to deal with them on their level - and on their level they'll beat you every time.

  • Hi Molerat, Thanks for your message. If I may correct your understanding, this has always been the remit of HMRC and continues to be so. The only reason I am having to deal with DWP IPC is that HMRC were a year behind in their replies and my request was passed to DWP as by then I had reached pension age.

  • To update… I called DWP IPC and queried why they were requesting additional proof not required by HMRC. Reply in a nutshell: that’s how it is if we reevaluate and decide we want proof… I could weep. To think all this could have been avoided if HMRC had not taken a year to process. I just hope a happy ending is possible.

It seems a bit arbitrary. As I said before, back in the 1990s I just gave the name and address of my foreign employer. Then I started to receive annual bills from HMRC. They've never asked if I'm still employed overseas. It might have been a good idea for the annual bill to also request information about my employment that year and maybe a payslip or earned income tax form. I've had 5 different foreign employers and I've never updated that information. In your case at least you now have a way forward, good luck.

And so we beat on, boats against the current, borne back ceaselessly into the past.

I agree. It is all a bit stupid. Unfortunately it took HMRC so long as they’ve been inundated with CF83 applications.

My son started this off in August 2022. Took a year back then for the first reply which needed more exact details on dates of his employment abroad. Sent back and then waited another year to finally get the list of Class 2 contributions he could make. Payment made September 2024 so 2 years after initial application. Shortly after April 2025 I got his to check his NI record to find they’d automatically part of his payment to 2024/25 even though they weren’t supposed to. Still nothing else allocated. Same for his wife. Fortunately got someone on the Digital Assistant who could sort it all out.

So from beginning to end it took 2.5 years. He at least had time to wait. Was there a particular reason that you left it so late?

  • Thank you! I also called HMRC about DWP moving the goalposts but although they sympathised they said there was nothing they could do as DWP is a different organisation.

Hi, Yes, I know I should have applied earlier but I only found out about 4 months before d’and lost a lot of time trawling websites to try to understand the criteria. Mea culpa - I’m paying for it now…
